EDP appears to be the most likely potential entrant in this market, considering (i) that it operates a CCGT for the production of electricity (and hence has access to large quantities of gas), which confers a strong incentive to enter the gas supply markets, (ii) that it could rely on its electricity customers (EDP controls close to 100 % of the electricity distribution in Portugal), to which it could offer a joint supply of gas and electricity (dual-fuel) and (iii) that it could also rely on the experience, the reputation and the customer base of the gas distributor Portgás.

As for the horizontal effects, the Commission came to the conclusion that, absent the merger, GDP would have been very likely to become the main competitor in the electricity markets in Portugal, considering (i) that having access to competitive gas resources confers a significant advantage in electricity as gas-fired power plants (CCGTs) now constitute the most common way of generating new power and (ii) that GDP, as a Portuguese company, could rely on its brand and gas customers, to which it could offer a joint supply of gas and electricity.

11. Lorsque des prestations spéciales à caractère non contributif visées à l'article 4 paragraphe 2 bis du règlement (CEE) n° 1408/71 peuvent, au cours de la même période et pour la même personne, être servies au titre de l'article 10 bis du même règlement par l'institution compétente de l'État membre sur le territoire duquel réside cette personne et au titre des paragraphes 1 à 10 du présent article par l'institution compétente d'un autre État membre, l'intéressé ne peut cumuler ces prestations que dans la limite du montant de la prestation spéciale la plus élevée à laquelle il pourrait prétendre en application d'une des législations en cause.
11. Where special non-contributory benefits as referred to in Article 4 (2a) of Regulation (EEC) No 1408/71 may, during the same period and for the same person, be granted pursuant to Article 10a of that Regulation by the competent institution of the Member State in the territory of which that person is resident and pursuant to paragraphs 1 to 10 of this Article by the competent institution of another Member State, the person concerned may only aggregate those benefits up to the limit of the highest amount of the special benefit he could claim under one of the legislations in question.
