TRADUCTIONS EN CONTEXTE

119. se félicite des engagements accrus de la part de l'Union et de la Tunisie, qui ressortent du plan d'action, et appelle les deux parties à l'adopter; prie instamment l'Assemblée nationale constituante de finaliser une constitution démocratique qui respecte les accords internationaux sur les droits de l'homme; demande l'organisation d'élections libres et régulières et regrette l'extension de l'état d'urgence; est d'avis que l'adoption d'une constitution résolument fondée sur les valeurs démocratiques et le respect des droits de l'homme, conformément aux souhaits des Tunisiens, un système judiciaire et des médias fonctionnels et indépendants, ainsi que la tenue de nouvelles élections, sont des éléments essentiels à la poursuite de la transition démocratique en Tunisie; est préoccupé par le nombre croissant de procès à l'encontre de journalistes en Tunisie; salue l'intégration dans le projet de constitution d'un article spécifique sur les droits de l'enfant conforme à la convention des Nations unies sur les droits de l'enfant, et recommande l'instauration d'un mécanisme indépendant afin de contrôler sa mise en œuvre;
119. Welcomes the strengthened commitments on the part of the Union and Tunisia as illustrated in the action plan, and calls on both parts to adopt that plan; urges the National Constituent Assembly to finalise a democratic constitution that respects international human rights agreements; calls for the organisation of free and fair elections, and regrets the extension of the state of emergency; takes the view that the adoption of a constitution firmly grounded in democratic values and respect for human rights, corresponding to the wishes of the Tunisian people, a functional and independent judiciary and media, and the holding of new elections are key elements for pursuing Tunisia’s political transition; is concerned about the increasing numbers of trials of journalists in Tunisia; welcomes the inclusion in the draft constitution of a specific article on children’s rights in line with the UN Convention on the Rights of the Child, and recommends the establishment of an independent mechanism to monitor its implementation;

B. considérant l'incapacité de l'Union européenne de développer une véritable politique étrangère cohérente et efficace vis-à-vis des partenaires de son voisinage immédiat du fait de la position de certains États membres et de leurs relations spéciales avec l'ancien régime tunisien; notant en particulier la faiblesse des mécanismes de coopération entre l'UE et la Tunisie et soulignant une nouvelle fois la demande du Parlement européen d'accompagner les clauses "droits de l'homme" des accords d'association d'un mécanisme de mise en œuvre de la clause,
B. whereas due to the stance of some Member States and their special relations with the previous regime in Tunisia, the European Union is unable to develop a genuine foreign policy that is consistent and effective vis-à-vis its partners in its immediate neighbourhood; whereas particular note is made of the weakness of the EU-Tunisia cooperation mechanisms and the need for human rights clauses in association agreements to be backed up by a mechanism implementing said clause is once more stressed,

3. demande au Chef de l'État tunisien d'accorder un passeport à Sihem Ben Sédrine, éditrice, et à Omar Mestiri, militant des droits de l'homme et de faire enlever les scellés aux portes de la maison d'édition Aloès de Madame Ben Sédrine, lieu dans lequel le journaliste Taoufik Ben Brik avait entamé sa grève de la faim afin de lui permettre de poursuivre ses activités professionnelles; prie également les autorités tunisiennes de réexaminer le cas de Hamma Hammami, directeur du journal El Badil et leader du POCT, condamné en août 1999 à neuf ans et trois mois de prison;
3. Urges the Tunisian Head of State to issue a passport to Sihem Ben Sédrine, publisher, and Omar Mestiri, a human rights activist, and to take the seals off the door of Mrs Ben Sédrine's publishing house Aloès, where the journalist Taoufik Ben Brik started his hunger strike, in order to allow her to carry on her professional activities; also calls on the Tunisian authorities to re-examine the case of Hamma Hammami, Director of the newspaper El Badil and leader of the POCT (Tunisian Communist Workers' Party), who was sentenced to nine years and three months imprisonment in August 1999;

1. demande aux autorités tunisiennes de respecter les engagements internationaux auxquels l'État tunisien a souscrit, de mettre fin aux actes d'intimidation et de harcèlement à l'encontre des défenseurs des droits de l'homme et de garantir l'exercice des droits et des libertés fondamentales et tout particulièrement, la libre expression, la libre association et la libre circulation en accordant ou en restituant à chacun un passeport;
1. Calls on the Tunisian authorities to respect international commitments to which the Tunisian State has subscribed, to put an end to acts of intimidation and harassment against those who defend human rights and to guarantee the exercise of fundamental rights and freedoms, in particular freedom of expression, freedom of association and freedom of movement, by issuing or returning passports to everyone;

Les dispositions arrêtées par le Conseil d'association conformément à l'article 67 ne portent pas atteinte aux droits et obligations découlant des accords bilatéraux liant la Tunisie et les États membres, dans la mesure où ceux-ci prévoient en faveur des ressortissants tunisiens ou des ressortissants des États membres un régime plus favorable.
The provisions adopted by the Association Council in accordance with Article 67 shall not affect any rights or obligations arising from bilateral agreements linking Tunisia and the Member States where those agreements provide for more favourable treatment of nationals of Tunisia or of the Member States.
