Where, despite a ship being perceived to be in a distress situation, the persons on board refuse to accept assistance, the participating unit shall inform the Rescue Coordination Centre and continue to fulfil a duty of care by surveying the ship at a prudent distance and by taking any measure necessary for the safety of the persons concerned, while avoiding to take any action that might aggravate the situation or increase the chances of injury or loss of life.

9. Dans les cas où le centre de coordination du sauvetage du pays tiers compétent pour la région de recherche et de sauvetage ne répond pas à la notification transmise par l'unité participante, celle-ci prend contact avec le centre de coordination du sauvetage de l'État membre d'accueil, à moins qu'un autre centre de coordination du sauvetage soit mieux placé pour assumer la coordination de l'opération de recherche et de sauvetage.
9. Where the Rescue Coordination Centre of the third country responsible for the search and rescue region does not respond to the notification transmitted by the participating unit, the latter shall contact the Rescue Coordination Centre of the host Member State unless another Rescue Coordination Centre is better placed to assume coordination of the search and rescue situation.
