7. 7. Where, though flying a foreign flag or refusing to show its flag, there are reasonable grounds to suspect that the vessel is, in reality, of the same nationality as a participating unit, that participating unit shall verify the vessel’s right to fly its flag. To that end, it may approach the suspect vessel.

Where the Rescue Coordination Centre of a third country responsible for the search and rescue region does not respond to the information transmitted by the participating unit, the latter shall contact the Rescue Coordination Centre of the host Member State unless that participating unit considers that another internationally recognised Rescue Coordination Centre is better able to assume coordination of the search and rescue situation.

3. Dans les cas visés au paragraphe 2, points a) et b), lorsque l’entreprise d’assurance ou de réassurance participante, la société holding d’assurance ou la compagnie financière holding mixte ayant son siège social dans l’Union est soit une entreprise liée d’une entité réglementée ou d’une compagnie financière holding mixte assujettie à une surveillance complémentaire conformément à l’article 5, paragraphe 2, de la directive 2002/87/CE, soit elle-même une entité réglementée ou une compagnie financière holding mixte assujettie à la même surveillance, le contrôleur du groupe peut, après consultation des autres autorités de contrôle concernées, décider de ne pas effectuer le contrôle de la concentration de risques visé à l’article 244 de la présente directive, le contrôle des transactions intragroupe visé à l’article 245 de la présente directive ou les deux, au niveau de cette entreprise d’assurance ou de réassurance participante, de cette société holding d’assurance ou de cette compagnie financière holding mixte.
3. In the cases referred to in points (a) and (b) of paragraph 2, where the participating insurance or reinsurance undertaking or the insurance holding company or mixed financial holding company which has its head office in the Union is either a related undertaking of, or is itself a regulated entity or a mixed financial holding company which is subject to supplementary supervision in accordance with Article 5(2) of Directive 2002/87/EC, the group supervisor may, after consulting the other supervisory authorities concerned, decide not to carry out the supervision of risk concentration referred to in Article 244 of this Directive, the supervision of intra-group transactions referred to in Article 245 of this Directive, or both, at the level of that participating insurance or reinsurance undertaking or that insurance holding company or mixed financial holding company.
