La Commission peut accorder au titulaire d'un brevet national ou communautaire ou au titulaire d'un droit d'obtention végétale qui ne peut pas exploiter son brevet (second brevet) ou son droit d'obtention végétale national ou communautaire sans porter atteinte à un brevet communautaire (premier brevet), sur demande, une licence obligatoire sur le premier brevet, à condition que l'invention ou l'obtention végétale revendiquée dans le second brevet ou le droit d'obtention végétale suppose un progrès technique important, d'un intérêt économique considérable, par rapport à l'invention revendiquée dans le premier brevet.
2. On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.

4. L’établissement de tissus ou l’organisme d’obtention doit avoir conclu un accord écrit avec le personnel ou les responsables des équipes cliniques chargés de l’obtention des tissus/cellules, sauf s’ils sont employés par le même établissement ou le même organisme, précisant le(s) type(s) de tissu(s) et/ou de cellule(s) et/ou d’échantillon(s) pour examen qui doivent être obtenus ainsi que les protocoles à suivre.

The tissue establishment or procurement organisation shall have written agreements with the staff or clinical teams responsible for tissue/cell procurement, unless they are employed by the same establishment or organisation, specifying the type(s) of tissues and/or cells and/or test samples to be procured and the protocols to be followed.

This Regulation shall, in relation to matters to which it applies, prevail over other provisions contained in bilateral or multilateral agreements or arrangements concluded by the Member States and in particular the Hague Convention of 1 March 1954 on Civil Procedure and the Hague Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters, in relations between the Member States party thereto.
