À cet égard, il est soutenu qu’en application des dispositions précitées, la Commission est tenue de réexaminer la dérogation provisoire introduite à l’annexe V, point 2, du règlement no 999/2001 et de soumettre au comité de la réglementation, en application de la procédure à cet effet prévue par l’article 5 bis de la décision 1999/468/CE, un projet de mesure de modification de ladite annexe V. Ceci afin de garantir le respect des normes sanitaires internationales adoptées par l’OIE, qui ne prévoient pas l’établissement d’une liste des matériels à risque spécifiés pour les pays qui, comme l’Italie, ont été reconnus comme étant des pays présentant un risque négligeable, c’est-à-dire comme des pays présentant un niveau de risque le plus faible suivant la classification internationale adoptée par l’OIE.
In that regard, the applicant claims that, pursuant to the provisions cited above, the Commission is obliged to review the temporary derogation introduced by point 2 of Annex V to Regulation No 999/2001 and to submit to the Scrutiny Committee, following the procedure outlined in Article 5a of Decision 1999/468/EC, a draft measure to amend that annex. This must be done in order to ensure compliance with the international health standards adopted by the [International Office of Epizootic Diseases (‘OIE’)], which do not call for a list of specified risk material from countries which — like Italy — have been recognised as countries with a negligible risk or as countries whose risk level is the lowest possible under the international classification system adopted by the OIE.
