When a decision relating to a protection measure falls within the scope of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters , Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility , or the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children , the recognition and enforcement of that decision should be carried out in accordance with the provisions of the relevant legal instrument.

1. souligne que l'évolution rapide du progrès technologique dans la société de l'information à l'échelle mondiale implique l'adoption de règles détaillées et cohérentes sur la protection des données; observe que, suite à l'entrée en vigueur du traité de Lisbonne, et compte tenu du fait que la Charte des droits fondamentaux est devenue juridiquement contraignante, l'article 16 du traité sur le fonctionnement de l'Union européenne (TFUE) pourrait offrir une base juridique spécifique pour l'adoption d'un instrument juridique concernant la protection des données personnelles, sous réserve qu'elle se fonde sur le degré le plus élevé de protection offert par la législation de l'UE, ce qui conférera une sécurité juridique accrue; considérant que l'article 8 de la Charte doit être, à cet égard, pleinement respecté;

Stresses that the rapid pace of technological development in the global information society calls for comprehensive and coherent rules on data protection; notes that, following the entry into force of the Lisbon Treaty and the Charter of Fundamental Rights becoming legally biding, Article 16 of the Treaty on the Functioning of the European Union (TFEU) could provide a specific legal basis for the adoption of one legal instrument on the protection of personal data, if based on the highest level of protection provided for in EU legislation, and that this would provide greater legal certainty; whereas Article 8 of the Charter must be fully complied with in this respect;

(11b) When a decision relating to a protection measure falls within the scope of Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, Council Regulation (EC) No 2201/2003 concerning jurisdiction and the recognition and enforcement of judgements in matrimonial matters and the matters of parental responsibility, or the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children, the recognition and enforcement of such decision should be carried out in accordance with the provisions of that legal instrument.
