(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast), certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.

Sans préjudice du paragraphe 3, les États membres peuvent exclure du champ d'application de l'article 8, paragraphe 3, les infrastructures ferroviaires locales et régionales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire, et du champ d'application du chapitre IV les infrastructures ferroviaires locales qui ne revêtent pas une importance stratégique pour le fonctionnement du marché ferroviaire. Les États membres notifient à la Commission leur intention d'exclure ce type d'infrastructures ferroviaires.
4. Without prejudice to paragraph 3, Member States may exclude local and regional railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Article 8(3) and local railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Chapter IV. Member States shall notify the Commission of their intention to exclude such railway infrastructures.

Étant donné que les objectifs de la présente directive, à savoir favoriser le développement des chemins de fer de l'Union, établir de grands principes en matière d'octroi de licences aux entreprises ferroviaires et coordonner les systèmes des États membres régissant la répartition des capacités de l'infrastructure ferroviaire et la perception des redevances d'utilisation de ladite infrastructure, ne peuvent pas être réalisés de manière suffisante par les États membres compte tenu de la dimension manifestement internationale de l'octroi de ces licences et du fonctionnement d'éléments importants des réseaux ferroviaires et compte tenu de la nécessité d'assurer des conditions d'accès équitables et non discriminatoires à l'infrastructure et peuvent donc, en raison de leurs aspects transnationaux, être mieux réalisés au niveau de l'Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l'article 5 du traité sur l'Union européenne.
Since the objectives of this Directive, namely to foster the development of the Union railways, to set out broad principles for granting licences to railway undertakings and to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof, cannot be sufficiently achieved by the Member States on account of the manifestly international dimension of issuing such licences and operating significant elements of the railway networks, and of the need to ensure fair and non-discriminatory terms for access to the infrastructure, and can therefore, by reason of their trans-national implications, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.
