This Directive lays down minimum rules concerning the right of access to a lawyer in criminal proceedings and in proceedings for the execution of a European arrest warrant pursuant to Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (European arrest warrant proceedings) and the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty.

Si des informations classifiées au niveau RESTREINT UE/EU RESTRICTED ou à son équivalent, ou des informations classifiées «autres informations confidentielles», sont déposées auprès d'un organe ou d'un titulaire de mandat au sein du Parlement autre que l'UIC, il incombe au secrétariat de cet organe ou à ce titulaire de mandat de veiller à ce que la consultation et le traitement desdites informations soient effectués en conformité avec l'article 7, paragraphe 3, à l'article 8, paragraphes 1, 2 et 4, à l'article 9, paragraphes 3 à 5, à l'article 10, paragraphes 2 à 6, et à l'article 11 de la présente décision ainsi qu'aux instructions de traitement applicables.
15. When information classified at the level RESTREINT UE/EU RESTRICTED or its equivalent and ‘other confidential information’ is deposited with a parliamentary body/office-holder other than the CIU, the secretariat of that parliamentary body/office-holder shall ensure that consultation and handling of the information in question complies with Article 7(3), Article 8(1), (2) and (4), Article 9(3), (4) and (5), Article 10(2) to (6), and Article 11 of this Decision and the appropriate handling instructions.

The right to written information about rights on arrest provided for in this Directive should also apply, mutatis mutandis, to persons arrested for the purpose of the execution of a European Arrest Warrant under Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (7).

Nonobstant le paragraphe 1, le mandat européen d’obtention de preuves porte aussi, lorsque l’autorité d’émission le précise, sur tout autre objet ou document ou toute autre donnée que l’autorité d’exécution découvre durant l’exécution dudit mandat et que, sans plus ample informé, elle juge utile à la procédure pour laquelle le mandat européen d’obtention de preuves a été émis.
5. Notwithstanding paragraph 1, the EEW shall, if so indicated by the issuing authority, also cover any other object, document or data, which the executing authority discovers during the execution of the EEW and without further enquiries considers to be relevant to the proceedings for the purpose of which the EEW was issued.

Les données relatives aux personnes recherchées en vue d'une arrestation aux fins de remise sont également introduites sur la base des mandats d'arrêt émis conformément aux accords conclus entre l'Union européenne et des pays tiers sur la base des articles 24 et 38 du traité UE, aux fins de remise de personnes sur la base d'un mandat d'arrêt, qui prévoient la transmission d'un tel mandat d'arrêt par le biais du système d'information Schengen.
2. Data on persons wanted for arrest for surrender purposes shall also be entered on the basis of arrest warrants issued in accordance with Agreements concluded between the European Union and third countries on the basis of Articles 24 and 38 of the EU Treaty for the purpose of surrender of persons on the basis of an arrest warrant, which provide for the transmission of such an arrest warrant via the Schengen Information System.

6. If the authority which receives a European arrest warrant is not competent to act upon it, it shall automatically forward the European arrest warrant to the competent authority in its Member State and shall inform the issuing judicial authority accordingly.

In case the European arrest warrant is issued for the purpose of executing a custodial sentence or detention order under the conditions of paragraph 1(d) and the person concerned has not previously received any official information about the existence of the criminal proceedings against him or her, he or she may, when being informed about the content of the European arrest warrant, request to receive a copy of the judgment before being surrendered.
