Il existe une infraction suffisamment qualifiée puisque, contrairement à l’information contenue dans la lettre du 22 juin 2012 concernant les documents à produire pour étayer les droits antérieurs dans la procédure d’opposition B002027251, l’OHMI a admis dans la décision d’opposition du 14 mai 2013 l’existence de conditions supplémentaires pour la preuve des droits antérieurs et n’a pas tenu compte, pour cette raison, des droits antérieurs de la requérante.
A sufficiently serious breach of law exists because, in the opposition decision of 14 May 2013, the Office assumed — contrary to the information contained in the letter of 22 June 2012 regarding the documents to be submitted in trade mark opposition proceedings B002027251 for the substantiation of earlier rights — additional requirements for proving the earlier rights and for that reason failed to take account of the applicant’s earlier rights.

In order to ensure uniform conditions for the implementation of this Regulation with regard to the methods of analysis for determining the composition of aromatised wine products; decisions on conferring protection on geographical indications and on rejecting applications for such protection; decisions on cancelling the protection of geographical indications and of existing geographical designations; decisions on approval of application for amendments in the case of minor amendments to the product specifications; the information to be provided in the product specification with regard to the definition of geographical indication; the means of making decisions on protection or rejection of geographical indications available to the public; relating to the submission of trans-border applications; checks and verifications to be carried out by Member States; the procedure, including admissibility, for the examination of applications for protection or for the approval of an amendment of a geographical indication, and the procedure, including admissibility, for requests for objection, cancellation or conversion and the submission of information relating to existing geographical designations; administrative and physical checks to be carried out by Member States; and rules on providing the information necessary for the application of the provision concerning the exchange of information between Member States and the Commission, the arrangements for the management of the information to be notified, the content, form, timing, frequency and deadlines of the notifications and arrangements for transmitting or making information and documents available to the Member States, the competent authorities in third countries, or the public; implementing power should be conferred on the Commission.

(19) In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the TFEU should be delegated to the Commission in respect of the establishment of production processes for obtaining aromatised wine products; criteria for the demarcation of geographical areas and rules, restrictions and derogations related to production in such areas; the conditions under which a product specification may include additional requirements; the determination of the cases in which a single producer may apply for the protection of a geographical indication and the restrictions governing the type of applicant that may apply for such protection; the establishment of the conditions to be complied with in respect of an application for the protection of a geographical indication, scrutiny by the Commission, the objection procedure and procedures for amendment and cancellation of geographical indications; the establishment of the conditions applicable to trans-border applications; the setting of the date for the submission of an application or a request, the date from which the protection applies and the date on which an amendment to a protection applies; the establishment of the conditions relating to amendments to product specifications, including the conditions when an amendment is considered minor and the conditions relating to the applications for, and approval of, amendments, which do not involve any change to the single document; the restrictions regarding the protected name; the nature and type of information to be notified in the exchange of information between Member States and the Commission, the methods of notification, the rules related to the access rights to information or information systems made availableandand the modalities of publication of the information.

Il convient de déléguer à la Commission, conformément à l’article 290 du traité, le pouvoir d’adopter des actes qui complètent ou modifient certains éléments non essentiels du présent règlement, à savoir compléter la liste de produits énoncée à l’annexe I du présent règlement; établir les restrictions et les dérogations concernant la provenance des aliments pour animaux dans le cas d’une appellation d’origine; établir des restrictions et des dérogations concernant l’abattage d’animaux vivants ou la provenance des matières premières; établir des règles limitant les informations contenues dans le cahier des charges du produit; définir les symboles de l’Union; établir des règles transitoires supplémentaires afin de protéger les droits et les intérêts légitimes des producteurs et des parties prenantes concernés; détailler les critères d’admissibilité des dénominations des spécialités traditionnelles garanties; établir des règles détaillées relatives aux mentions de qualité facultatives; réserver une mention de qualité facultative supplémentaire, préciser ses conditions d’utilisation et les modifier; établir des dérogations aux conditions d’utilisation de la mention «produit de montagne» et définir les méthodes de production et d’autres critères pertinents pour l’application de cette mention de qualité facultative, notamment les conditions dans lesquelles les matières premières ou les aliments pour animaux peuvent provenir de l’extérieur des zones de montagne; fixer des règles supplémentaires afin de déterminer le caractère générique de mentions dans l’Union; établir des règles pour l’utilisation du nom d’une variété végétale ou d’une race animale; définir les règles d’exécution de la procédure nationale d’opposition pour ce qui est des demandes communes concernant plusieurs territoires nationaux; et compléter les règles relatives à la procédure de demande, à la procédure d’opposition, à la procédure de demande de modification et à la procédure d’annulation ...
In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of supplementing the list of products set out in Annex I to this Regulation; establishing the restrictions and derogations with regard to the sourcing of feed in the case of a designation of origin; establishing restrictions and derogations with regard to the slaughtering of live animals or with regard to the sourcing of raw materials; laying down rules which limit the information contained in the product specification; establishing the Union symbols; laying down additional transitional rules in order to protect the rights and legitimate interests of producers or stakeholders concerned; laying down further details on the eligibility criteria for the names of traditional specialities guaranteed; laying down detailed rules relating to the criteria for optional quality terms; reserving an additional optional quality term, laying down its conditions of use and amending those conditions; laying down derogations to the use of the term ‘mountain product’ and establishing the methods of production, and other criteria relevant for the application of that optional quality term, in particular, laying down the conditions under which raw materials or feedstuffs are permitted to come from outside the mountain areas; laying down additional rules for determining the generic status of terms in the Union; laying down rules for determining the use of the name of a plant variety or of an animal breed; defining the rules for carrying out the national objection procedure for joint applications concerning more than one national territory; and for complementing the rules of the application process, the opposition process, the amendment application process and the cancellation process in general.

5. Tout acte délégué adopté conformément à l'article 4, paragraphe 1, n'entre en vigueur que si le Parlement européen ou le Conseil n'a pas fait connaître son opposition dans un délai de deux mois à compter de la notification dudit acte au Parlement européen et au Conseil ou si, avant l'expiration dudit délai, le Parlement européen et la Conseil ont tous deux informé la Commission qu'ils ne comptaient pas faire opposition.
5. A delegated act adopted pursuant to Article 4(1)shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object.

4. Lorsqu’un recours concerne l’accès aux données introduites par Europol dans son système d’information, aux données stockées dans les fichiers de travail aux fins d’analyse ou dans tout autre système établi par Europol pour traiter les données à caractère personnel conformément à l’article 10, et en cas d’opposition persistante d’Europol, l’autorité de contrôle commune ne peut passer outre à cette opposition qu’à la majorité des deux tiers de ses membres, après avoir entendu Europol et l’État membre ou les États membres visé(s) à l’article 30, paragraphe 4.
4. Where an appeal relates to access to data input by Europol in the Europol Information System or data stored in the analysis work files or in any other system established by Europol for the processing of personal data pursuant to Article 10 and where objections from Europol persist, the Joint Supervisory Body shall be able to overrule such objections only by a majority of two thirds of its members after having heard Europol and the Member State or Member States referred to in Article 30(4).

Un acte délégué adopté en vertu de l’article 45 entre en vigueur si le Parlement européen ou le Conseil n’a pas fait connaître son opposition dans un délai de deux mois à compter de la notification dudit acte au Parlement européen et au Conseil ou si, avant l’expiration dudit délai, le Parlement européen et le Conseil ont tous deux informé la Commission de leur intention de ne pas faire opposition.
