1. Le présent règlement institue une Agence de l’Union européenne chargée de la sécurité des réseaux et de l’information (ENISA, ci-après dénommée «Agence») afin d’exécuter les tâches qui lui sont assignées en vue de contribuer à un niveau élevé de sécurité des réseaux et de l’information au sein de l’Union et en vue de sensibiliser la société à la sécurité des réseaux et de l’information et de favoriser l’émergence et promouvoir une culture de la sécurité des réseaux et de l’information, dans l’intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l’Union, contribuant ainsi à l’établissement et au bon fonctionnement du marché intérieur.
1. This Regulation establishes a European Union Agency for Network and Information Security (ENISA, hereinafter ‘the Agency’) to undertake the tasks assigned to it for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness of network and information security and to develop and promote a culture, of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market.

Étant donné que l’objectif du présent règlement, à savoir instituer une Agence de l’Union européenne pour la sécurité des réseaux et de l’information en vue de contribuer à un niveau élevé de sécurité des réseaux et de l’information dans l’Union, et en vue de sensibiliser la société et de favoriser l’émergence et promouvoir, dans la société, une culture de la sécurité des réseaux et de l’information, dans l’intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l’Union, contribuant ainsi à l’établissement et au bon fonctionnement du marché intérieur, ne peut pas être atteint de manière suffisante par les États membres et peut donc être mieux atteint au niveau de l’Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l’article 5 du traité sur l’Union européenne.
Since the objective of this Regulation, namely to establish a European Union Agency for Network and Information Security for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness and develop and promote a culture of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

D'autres critères et conditions de nature structurelle et générale, se rapportant à l'échange de compétences techniques, aux systèmes d'information et aux outils de santé en ligne, devraient contribuer à l'élaboration, au partage et à la diffusion des connaissances et des informations et, partant, favoriser l'amélioration du diagnostic et du traitement des maladies à la fois à l'intérieur et à l'extérieur du réseau et faciliter une étroite collaboration avec les autres réseaux et centres d'expertise au niveau tant national qu'international. L'interopérabilité et la compatibilité sémantique des systèmes recourant aux technologies de l'information et de la communication (TIC) devraient faciliter l'échange des données médicales et des informations relatives aux patients et contribuer à la création et à l'exploitation de bases de données et de registres partagés.
Further horizontal and structural criteria and conditions related to the exchange of expertise, information systems and eHealth tools should help developing, sharing and spreading information and knowledge and fostering improvements in the diagnosis and treatment of diseases within and outside the Networks and to collaborate closely with other centres of expertise and networks at national and international level. Interoperable and semantically compatible information and communication technology (ICT) systems would facilitate the exchange of health data and patients' information, and the establishment and maintenance of shared databases and registries.

La convention de la Commission économique pour l'Europe des Nations unies (CEE-ONU) sur l'accès à l'information, la participation du public au processus décisionnel et l'accès à la justice en matière d'environnement (ci-après dénommée «convention d'Aarhus»), signée par la Communauté européenne le 25 juin 1998, reconnaît qu'un meilleur accès à l'information environnementale et la diffusion de cette information contribuent à sensibiliser davantage le public aux problèmes environnementaux, à lui permettre d'exprimer librement son point de vue et de participer plus efficacement au processus décisionnel en matière d'environnement, et contribuent, à terme, à un meilleur environnement.
The UNECE Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters (hereinafter ‘the Aarhus Convention’), signed by the European Community on 25 June 1998, recognises that increased public access to environmental information and the dissemination of such information contribute to a greater awareness of environmental matters, a free exchange of views, more effective participation by the public in environmental decision-making and, eventually, to a better environment.

L'agence s'est également vu confier le renforcement de la coopération entre les parties impliquées dans le secteur de la sécurité des réseaux et de l'information, fournissant son assistance à la Commission et aux Etats Membres dans leur dialogue avec l'industrie pour aborder des problèmes relatifs à la sécurité dans les produits et logiciels et pour contribuer aux efforts de coopération de la Communauté avec les Etats tiers et, lorsque cela est approprié, avec les organisations internationales pour promouvoir une approche globale commune sur les questions de sécurité des réseaux et de l'information, contribuant ainsi au développement d'une culture de sécurité des réseaux et de l'information[10].
The Agency is also entrusted with enhancing cooperation between those involved in the area of network and information security, providing assistance to the Commission and the Member States in their dialogue with industry to address security-related problems in hardware and software products and contributing to Community efforts to cooperate with third States and, where appropriate, with international organisations to promote a common global approach to network and information security issues, thereby contributing to the development of a culture of network and information security.[10]

La task force des chefs de police et Europol devraient contribuer à la diffusion des renseignements et des informations relatives aux niveaux de sécurité auprès des organes de répression des États membres qui, à leur tour, devraient être en contact avec les propriétaires et les exploitants des infrastructures critiques, les conseiller au sujet des informations relatives à la menace terroriste et contribuer à mettre en place des stratégies de protection contre le terrorisme.
The Task Force of the Chiefs of Police and Europol would have a role to play in disseminating the relevant security levels and intelligence information to the Member States' law enforcement agencies, who in their turn should advise and liaise with critical infrastructure owners and operators on relevant threat information, assist in the provision of protective security advice and development of protective security strategies to counter terrorism.
