In most Member States, temporary agency workers are counted in the temporary-work agency employing them (Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Hungary, Ireland, Italy, Lithuania, Malta, Poland, Slovenia, Spain, Sweden and United Kingdom) or in both the agency and the user undertaking to which they are assigned (Austria, Cyprus, France, Germany, Greece, Luxembourg, Netherlands, Portugal and Slovakia).

This justification has been resorted to with respect to measures as diverse as restrictions on the nature of the tasks that may be assigned to agency workers (Italy, Poland), the possibility for national collective agreements to set quantitative limits on the use of fixed-term contracts for agency work (Italy), or the need, in certain cases for the user undertaking to obtain the consent of its union delegation before using agency workers (Belgium).

4. Sans préjudice de l’article 5, paragraphe 1, les travailleurs intérimaires ont accès, dans l’entreprise utilisatrice, aux installations et aux équipements collectifs, notamment aux services de restauration, aux infrastructures d’accueil des enfants et aux services de transport, dans les mêmes conditions que les travailleurs employés directement par cette entreprise, à moins que la différence de traitement ne soit justifiée par des raisons objectives.
4. Without prejudice to Article 5(1), temporary agency workers shall be given access to the amenities or collective facilities in the user undertaking, in particular any canteen, child-care facilities and transport services, under the same conditions as workers employed directly by the undertaking, unless the difference in treatment is justified by objective reasons.
