Is concerned that the error rate resulting from the ex post audits, performed by or on behalf of the Joint Undertaking was 5,82 %; recognises that most of these errors were relatively small in amounts to be adjusted (less than EUR 5 000 in favour of the Joint Undertaking; notes that steps have since been taken to recover or offset these amounts from subsequent claims and that the rate will continue to evolve on a multiannual basis as more projects, beneficiaries and claims are audited; points out that actions taken by the Joint Undertaking to prevent and correct these errors have a bearing on the residual error rate;

Pour la mise en œuvre de l'initiative technologique conjointe Clean Sky, une entreprise commune au sens de l'article 171 du traité, dénommée "entreprise commune Clean Sky" (ci-après "entreprise commune Clean Sky"), est créée pour une période se terminant le 31 décembre 2017. Il sera assuré qu'après le dernier appel de propositions en 2013, les projets en cours seront exécutés, contrôlés et financés jusqu'en 2017. L'entreprise commune Clean Sky est un organisme tel que visé à l'article 185 du règlement financier et au point 47 de l'AII du 17 mai 2006.
1. For the implementation of the Joint Technology Initiative on "Clean Sky", a Joint Undertaking within the meaning of Article 171 of the Treaty, whose name is "Clean Sky Joint Undertaking", is hereby set up for a period up to 31 December 2017 (hereinafter referred to as "Clean Sky Joint Undertaking").It shall be ensured that after the last call for proposals in 2013 the running projects are implemented, monitored and funded until 2017.The Clean Sky Joint Undertaking is a body as referred to in Article 185 of the Financial Regulation and Point 47 of the IIA of 17 May 2006.

4. Tout paiement de l'entreprise commune destiné à couvrir la responsabilité mentionnée aux paragraphes 1 et 2 ainsi que les frais et dépenses exposés en relation avec celle-ci sont considérés comme dépenses de l'entreprise commune et seront couvertes par les ressources de l'entreprise commune.
4. Any payment by the Joint Undertaking in respect of the liability referred to in paragraphs 1 and 2 and the costs and expenses incurred in connection therewith shall be considered as expenditure of the Joint Undertaking and shall be covered by the resources of the Joint Undertaking.

Vu la nature particulière des activités de l'entreprise commune et son importance pour le développement de la recherche dans le domaine de la fusion, et afin de promouvoir une gestion saine et économiquement acceptable des fonds publics qui seront octroyés à l'entreprise commune, il convient que tous les avantages prévus à l'annexe III du traité soient conférés à l'entreprise commune.
In view of the particular nature of the activities of the Joint Undertaking and its importance for the development of fusion research and in order to promote a sound and economic management of the public funding to be provided to the Joint Undertaking, all the advantages provided for in Annex III to the Treaty should be conferred on the Joint Undertaking.
