Emphasises the fact that, as already pointed out in the Court of Auditors' 2010 report, the Joint Undertaking needs to enhance its efforts to increase competition as the number of offers received for the operational procurement procedures signed in 2011 was still low and amounted to two on average while for grants the average number of proposals received was only one per call; acknowledges that the Joint Undertaking's nature of work is characterised by the procurement of high technological components, never built before and without any commercial value, designed for the construction of an experimental fusion reactor in an extremely complex market in which monopoly or oligopoly situations are predominant; reiterates that the Joint Undertaking must find value for money in all possible acquisitions;

Underlines that according to Article 6 of the SESAR Financial Rules, no expenditure may be committed or authorised in excess of the appropriations authorised by the budget; is seriously concerned that for two budget headings – administrative expenditure, studies and development – authorised expenditure exceeded budgetary appropriations by 11 % and 9 % respectively; takes note that the Joint Undertaking considers that it can only enter the total payment appropriations once into the overall budget for 2007-2016, in order to avoid exceeding the total budget ceiling by the end of the SESAR development phase in 2016; reminds the Joint Undertaking that it must comply with its own Financial Rules and expects that authorised expenditure exceeding budgetary appropriations shall not occur in future financial years;

2. In the case of non-contractual liability, the Joint Undertaking shall, in accordance with the general principles common to the laws of the Member States, make good any damage caused by its servants in the performance of their duties.

5. Toute décision relative à l'adhésion de nouveaux membres (au sens de l'article 1er, paragraphe 2), à la nomination du directeur exécutif, aux propositions de modification des présents statuts, aux propositions faites à la Commission concernant la durée de l'entreprise commune, à la dissolution de l'entreprise commune ou aux décisions prises en application de l'article 23 doit recueillir le vote positif du représentant de la Communauté au sein du conseil d'administration.
5. Any decision relating to the accession of new members (within the meaning of Article 1(2)), the appointment of the Executive Director, proposed amendments to these Statutes, proposals to the Commission on the duration of the Joint Undertaking, the dissolution of the Joint Undertaking or decisions taken under Article 23 shall require the positive vote of the Community’s representative on the Administrative Board.

(17) In formulating its proposal for the nomination of the Director of the Joint Undertaking, the Commission should consider that he/she be appointed on the grounds of merit and managerial skills, as well as competence and relevant experience, and should be independent of any undertaking in the performance of his/her duties,

L'article 9 des statuts stipule, dans la proposition que nous faisons, qu'en matière de passation de marchés, le comité exécutif doit agir en toute indépendance vis-à-vis du conseil d'administration dans lequel seraient représentées les entreprises participantes à l'entreprise commune, c'est-à-dire que le comité exécutif agirait en marge des entreprises qui pourront, le cas échéant, participer aux appels d'offre.
Article 9 of the Statutes says that, in the proposal we are making, in the field of contracting, the executive committee must act totally independently from the management board in which the companies participating in the Joint Undertaking would be represented, that is to say that the executive committee acts independently of the companies which may participate in tenders.
