– in one procurement procedure, an increase of 32 % was observed in comparison to the initial cost estimate; notes furthermore that in two other procurement procedures, due to the nature of the information available in the files, the reconciliation of the difference between the final contract value with the initial estimation value was proven as complicated; acknowledges from the Joint Undertaking that the complexity of the reconciliation is due to the re-evaluation of the initial scope of the contract, which led to an increase of time as well as to the nature, complexity and amounts involved in such contracts;

3. observe que dans ses conclusions adoptées le 7 juillet 2010 , le Conseil avait approuvé un montant de 6,6 milliards d'euros en valeur de 2008 pour la contribution de l'entreprise commune à la phase de construction du projet ITER; souligne avec préoccupation que, d'après les observations de la Cour, ce montant représente le double de celui des coûts initialement inscrits au budget et ne tenait pas compte du montant de 663 000 000 EUR proposé par la Commission pour faire face à d'éventuels imprévus; estime que l'augmentation considérable du coût du projet risque de menacer l'existence d'autres programmes également financés par le budget de l'Union et pourrait être contraire au principe de rentabilité;

Observes that the Council's conclusions adopted on 7 July 2010 approved EUR 6,6 billion in 2008 values, in order for the Joint Undertaking to contribute to the ITER construction phase of the project; points out with concern from the Court’s emphasis of matter that this amount is double compared to the initial budgeted costs and did not include an amount of EUR 663 000 000 proposed by the Commission and intended to cover potential contingencies; considers that the significant increase of the project may put into danger other programmes which are also financed by the Union’s budget and may be contradictory to the ''value for money'' principle;

L’enquête de la Commission a également montré que les concurrents des parties concernées n'auraient eu ni la capacité ni la motivation nécessaires pour accroître suffisamment leur production afin de compenser une augmentation des prix par la nouvelle entreprise commune.
The Commission's investigation also revealed that the parties' competitors would have had neither the capacity nor the incentives to expand production sufficiently to outweigh a price increase by the new joint venture.

L’enquête approfondie a également exclu la possibilité que la création de l'entreprise commune augmente le risque de coordination sur le marché du jus d'orange, dans la mesure où l'opération accroît le décalage entre les parts de marché des principaux fournisseurs et ne semble pas modifier la situation actuelle de manière telle qu’une coordination serait plus probable, stable ou efficace.
The in-depth investigation also ruled out the possibility that the creation of the joint venture could lead to an increased risk of coordination on the orange juice market as the transaction increases the asymmetry in market shares between the main suppliers and does not appear to change the current situation in a way that would make coordination more likely, stable or effective.
