Acknowledges from the Joint Undertaking's reply to the Court of Auditors that the roles of the Joint Undertaking's internal audit function and the IAS were clarified and formalised through the approval, in March 2011, of the IAS and IAC Audit Charters; also takes note that a coordinated strategic audit plan for the period 2012-2014 is also being prepared to ensure that the impact of planned audits is optimised and any duplication of audit work between the IAS and IAC is minimised; calls therefore on the Joint Undertaking to inform the discharge authority about the state of preparation and implementation of the strategic audit plan for the period 2012-2014;

Takes note that at the end of 2011, the Joint Undertaking's internal audit capability had not yet been set up; recalls that the Commission's Internal Audit Service is the Internal Auditor of the Joint Undertaking since 2010 and that carried out a risk assessment exercise and a strategic audit plan for 2012-2014 was presented to the Governing Board of the Joint Undertaking; acknowledges that taking into account the size of the Joint Undertaking will perform also the role of the Internal Audit Capability;

6. se félicite du fait qu'en novembre 2011, le conseil d'administration de l'entreprise commune a adopté pour cette dernière un plan d'audit stratégique en coordination avec le service d'audit interne de la Commission pour la période 2012-2014, suite à la clarification des rôles respectifs du service d'audit interne de la Commission et de la fonction d'audit interne de l'entreprise commune; attend d'être informé des résultats de la mise en œuvre de ce plan d'audit stratégique et attire l'attention sur le fait que l'entreprise commune a été constituée en février 2007;

Welcomes the fact that in November 2011, the Administrative Board of the Joint Undertaking adopted a Coordinated Internal Audit Service Strategic Audit Plan for the Joint Undertaking for the period 2012-2014 following the clarification of the operational roles of the Commission's Internal Audit Service and of the Joint Undertaking's internal auditing function; expects to be informed about the results of the implementation of that Strategic Audit Plan and draws the attention to the fact that the Joint Undertaking was set up in February 2007;

The Joint Undertaking, which should be responsible for public research activities of European and international interest, and discharge commitments pursuant to international agreements, should be considered as an international body within the meaning of Article 151(1)(b) of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax , and as an international organisation within the meaning of the second indent of Article 23(1) of Council Directive 92/12/EEC of 25 February 1992 on the general arrangements for products subject to excise duty and on the holding, movement and monitoring of such products , Article 22 of Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors , and Article 15 of Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts
