Lorsque les entités adjudicatrices font usage de la possibilité de se référer aux spécifications visées au paragraphe 3, point a), elles ne peuvent pas rejeter une offre au motif que les produits et services offerts sont non conformes aux spécifications auxquelles elles ont fait référence, dès lors que le soumissionnaire prouve dans son offre à la satisfaction de l'entité adjudicatrice, par tout moyen approprié, que les solutions qu'il propose satisfont de manière équivalente aux exigences définies par les spécifications techniques.
4. Where a contracting entity makes use of the option of referring to the specifications mentioned in paragraph 3(a), it cannot reject a tender on the ground that the products and services tendered for do not comply with the specifications to which it has referred, once the tenderer proves in his tender to the satisfaction of the contracting entity, by whatever appropriate means, that the solutions which he proposes satisfy in an equivalent manner the requirements defined by the technical specifications.
