Lorsqu’un opérateur économique n’a manifestement pas la possibilité d’obtenir le label particulier spécifié par l’entité adjudicatrice ou un label équivalent dans les délais fixés pour des raisons qui ne lui sont pas imputables, l’entité adjudicatrice accepte d’autres moyens de preuve appropriés tels que, par exemple, un dossier technique du fabricant, pour autant que l’opérateur économique concerné établisse que les travaux, fournitures ou services qu’il doit fournir satisfont aux exigences concernant le label particulier ou aux exigences particulières indiquées par l’entité adjudicatrice.
Where an economic operator had demonstrably no possibility of obtaining the specific label indicated by the contracting entity or an equivalent label within the relevant time limits for reasons that are not attributable to that economic operator, the contracting entity shall accept other appropriate means of proof, which may include a technical dossier of the manufacturer, provided that the economic operator concerned proves that the works, supplies and services to be provided by it fulfil the requirements of the specific label or the specific requirements indicated by the contracting entity.

However, it is appropriate to ensure that this exclusion does not give rise to distortions of competition to the benefit of the undertakings or joint ventures that are affiliated with the contracting entities; it is appropriate to provide a suitable set of rules, in particular as regards the maximum limits within which the undertakings may obtain a part of their turnover from the market and above which they would lose the possibility of being awarded contracts without calls for competition, the composition of joint ventures and the stability of links between these joint ventures and the contracting entities of which they are composed.

Cet amendement est également inacceptable - d'un côté, les entités adjudicatrices devant obtenir des services de traduction et interprétation peuvent avoir besoin de la même flexibilité que d'autres entités adjudicatrices, d'autre côté il n'y a aucune justification pour soumettre la passation de marchés ou accords-cadres ayant pour objet cette catégorie de services relevant de l'annexe XVIB, à d'autres règles de procédure détaillées que celles applicables à d'autres services de la même annexe.
This amendment is also unacceptable: for one thing, contracting entities which have to procure translation and interpreting services may need the same flexibility as other contracting entities; for another, there is no justification whatsoever for making the award of framework contracts or agreements concerning this category of services covered by Annex XVIB subject to detailed rules of procedure different from those applicable to other services covered by the same Annex.
