TRADUCTIONS EN CONTEXTE

1. Lorsqu'une appellation d'origine ou une indication géographique est protégée au titre du présent règlement, l'enregistrement d'une marque commerciale correspondant à l'une des situations visées à l'article 45, paragraphe 2, et concernant un produit relevant d'une des catégories répertoriées à l'annexe IV est refusé si la demande d'enregistrement de la marque commerciale est présentée après la date de dépôt auprès de la Commission de la demande de protection de l'appellation d'origine ou de l'indication géographique et que cette demande aboutit à la protection de l'appellation d'origine ou l'indication géographique.
1. Where a designation of origin or a geographical indication is protected under this Regulation, the registration of a trademark corresponding to one of the situations referred to in Article 45(2) and relating to a product falling under one of the categories listed in Annex IV shall be refused if the application for registration of the trademark is submitted after the date of submission of the application for protection of the designation of origin or geographical indication to the Commission and the designation of origin or geographical indication is subsequently protected.

Conformément à l'article 10, paragraphe 1, point c), du règlement (UE) no 1151/2012, la partie à l'origine de l'opposition a fait valoir que l'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée compromettrait l'existence d'une dénomination partiellement homonyme, de marques et de produits qui ont été mis sur le marché polonais en toute légalité bien plus de cinq ans avant la date de publication au Journal officiel de l'Union européenne (15 juin 2013) de la demande d'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée. Selon cette même partie, cet enregistrement compromettrait l'existence du produit dénommé «Liliput», un fromage polonais présentant des caractéristiques similaires au fromage «Liliputas» et dont le nom est phonétiquement semblable au nom «Liliputas».
In accordance with Article 10(1)(c) of Regulation (EU) No 1151/2012 the opponent alleged that the registration of ‘Liliputas’ as a Protected Geographical Indication would jeopardise the existence of a partly identical name, of trade marks and of products which have been legally on the Polish market for significantly more than five years preceding the date the application for registration of the name ‘Liliputas’ as Protected Geographical Indication was published in the Official Journal of the European Union (15 June 2013); according to the opponent, that registration would be a threat to the existence of the product named ‘Liliput’, which is a Polish cheese having characteristics similar to ‘Liliputas’ cheese and whose name is phonetically similar to the name ‘Liliputas’.

There should be procedures to permit amendment of specifications on request of groups having a legitimate interest, after registration, in the light of technological progress and cancellation of the geographical indication or designation of origin for an agricultural product or foodstuff, in particular if that product or foodstuff ceases to conform to the specification on the basis of which the geographical indication or designation of origin was granted.

3. Aux fins d'établir si la personne concernée représente un danger pour l'ordre public ou la sécurité publique, l'État membre d'accueil peut, lors de la délivrance de l'attestation d'enregistrement ou, s'il n'existe pas de système d'enregistrement, au plus tard dans les trois mois suivant l'entrée de la personne concernée sur son territoire ou à compter de la date à laquelle cette personne a signalé sa présence sur son territoire conformément à l'article 5, paragraphe 5, ou encore lors de la délivrance de la carte de séjour et s'il le juge indispensable, demander à l'État membre d'origine et, éventuellement, à d'autres États membres des renseignements sur les antécédents judiciaires de la personne concernée.
3. In order to ascertain whether the person concerned represents a danger for public policy or public security, when issuing the registration certificate or, in the absence of a registration system, not later than three months from the date of arrival of the person concerned on its territory or from the date of reporting his/her presence within the territory, as provided for in Article 5(5), or when issuing the residence card, the host Member State may, should it consider this essential, request the Member State of origin and, if need be, other Member States to provide information concerning any previous police record the person concerned may have.
