(9) This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

7. s'inquiète du fait que les dix pays adhérents n'ont pas encore complètement transposé l'acquis en matière de lutte contre la discrimination et doivent, par exemple, encore mettre en place un organisme chargé de l'égalité, comme l'exige l'acquis; fait remarquer que certains pays, comme la Slovénie et la Lituanie, sont en bonne voie, alors que d'autres, comme la Hongrie, la République tchèque et la Slovaquie, ont encore d'importants problèmes à régler en ce qui concerne les discriminations touchant la minorité rom, et la Lettonie, quant à elle, rencontre toujours certaines difficultés pour intégrer réellement la minorité russe; souligne que, en matière de lutte contre les discriminations et d'intégration des minorités, il est également essentiel de prendre en considération la question de l'égalité entre les femmes et les hommes; dans ce contexte, exprime également de vives inquiétudes au sujet de Malte qui n'a pas encore totalement transposé la directive portant création d'un cadre général en faveur de l'égalité de traitement en matière d'emploi et de travail et demande que cela soit réalisé avant l'adhésion;

Is worried about the fact that all ten accession countries still have not fully transposed the anti-discrimination acquis, notably all countries still need to establish the Equality Body required by the acquis. Some countries such as Slovenia and Lithuania are well under way, whereas others, notably Hungary, Czech Republic and Slovakia, still have large problems in relation to discrimination of the Roma minorities and Latvia still has some problems in relation to real integration of the Russian minority. Underlines that, in dealing with anti-discrimination and integration of minorities, it is crucial to analyse the gender perspective as well; in this regard also expresses considerable concern that Malta still has not fully transposed the Directive on equal treatment in employment and demands that this happens before accession;

déplore que la discrimination exercée à l'encontre des femmes et des employés âgés n'a pas encore été véritablement supprimée en Pologne; invite instamment le gouvernement à prendre des mesures efficaces pour continuer à développer des stratégies de l'emploi et de l'intégration, et invite la Pologne à intégrer la prise en compte du genre dans tous les domaines dans sa législation sur le travail et à mettre en place le bureau pour l'égalité prévu par l'acquis; souligne qu'un grand nombre de textes législatifs doivent encore être adoptés pour que la Pologne atteigne le niveau de l'acquis en ce qui concerne la durée du temps de travail et le travail à temps partiel, les comités d'entreprise et le travail posté et que le dialogue social autonome et bilatéral entre employeurs et représentants des employés dénote de graves lacunes en Pologne;
Regrets that discrimination against women and older employees has not yet been properly eliminated in Poland urges the government to take effective steps to continue to develop employment and integration strategies and calls on Poland to incorporate gender mainstreaming into its labour law and to set up the equality body required by the acquis; underlines that a great deal of legislative work still needs to be done to bring Poland into line with the acquis regarding working time and part-time working, works councils, and the posting of workers and that there are serious shortcomings in the autonomous bilateral social dialogue between employer and employee representatives in Poland;

[7] Article 8 of the Protocol incorporating the Schengen acquis in the European Union provides that "the Schengen acquis and further measures taken by the institutions within its scope shall be regarded as an acquis which must be accepted in full by all States candidates for admission".
