To be consistent with current constitutional protections like freedom of religion and expression, autonomy and security of the person (as in the right to abortion), and " right to liberty" guaranteed under section 7 of the Charter, one might argue, any rational analysis of relative harm cannot justify criminalizing simple possession of a drug such as cannabis.
