The shortcomings and non-conformities identified in the Reasoned Opinion included concerns about: the application of broader exemptions from the principle of free access to environmental information than the Directive allows; the failure to ensure that direct access to documents is ensured in all cases; the existence of derogations from the time limit within which the Directive requires a response to be provided to information requests and the incorrect transposition of the definition of bodies other than public authorities which should be covered by the Directive.
