Lawrence MacAulay: With regard to the Department of Fisheries and Oceans' Policy for Preserving the Independence of the Inshore Fleet in Canada's Atlantic Fisheries (PIIFCAF): (a) does the government agree with this policy's statement that the strength of the independence of the inshore fleet is achieved through the termination of controlling agreements; (b) does the government have plans to amend or terminante the PIIFCAF and when will the amendments or termination take place; (c) is the government committed to the independence of the inshore fleet; and (d) does the government plan to maintain the controlling agreements beyond their March 2014 deadline?

Acknowledges the steps taken by the Montenegrin Government to ensure freedom of expression in the media through the adoption of the law on electronic media and amendments to the Criminal Code but calls for further steps to ensure the independence and professionalism of media outlets, including strengthening the capacity and independence of the public broadcaster; calls on the Montenegrin authorities to demonstrate their commitment with a view to ensuring that the media sector operates without political interference and that the independence of regulatory bodies is guaranteed; draws attention to disproportionate fines for defamation, which continue to hamper the freedom and independence of the work of journalists, and calls for the legislation and practice on defamation to be aligned fully with the jurisprudence of the European Court of Human Rights; stresses that reported cases of intimidation and physical violence against journalists as well as against civil society activists must be fully investigated and prosecuted where appropriate; underlines the importance of journalists applying high professional standards and a professional code of ethics;

In order to help create an independent and impartial judiciary, is pleased with the substantial efforts to further reform the judiciary, in particular with the adoption of the revised judicial reform action plan; welcomes the progress in further reducing the backlog of cases, especially those where proceedings last more than three years, and rationalising the court system by setting up larger courts, county courts and commercial courts as well as by arranging for judges to specialise; notes the positive steps, including with regard to the State Judicial Council, the independence of the Judicial Academy and the establishment of the school for judicial officers, to reinforce the independence of judicial appointments and to improve career development and the disciplinary liability of chief judges as well as the adoption of general safeguards for enhanced independence of the judiciary;

Nous devons assurer l’indépendance de ce processus qui tient à l’esprit même de ce projet de loi et nous devons également examiner les modalités de nomination de ceux qui siégeront à ce tribunal pour nous assurer qu’ils représentent toutes les parties, et qu’ils sont vraiment indépendants et en mesure de prendre les meilleures décisions possibles en matière de revendications particulières.
We need to ensure the independence of this process, which is the intention of this legislation, but we also need to consider the appointment process of those who sit on the tribunal to ensure they are representative of all the parties, are truly independent and can make the best and most appropriate decisions related to these specific claims.
