Very significant advances in this direction have already been achieved by Council Directive 72/166/EEC of 24 April 1972 on the approximation of the laws of Member States relating to insurance against civil liability in respect of the use of motor vehicles, and to the enforcement of the obligation to insure against such liability (4), by second Council Directive 84/5/EEC of 30 December 1983 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles (5), by third Council Directive 90/232/EEC of 14 May 1990 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles (6) and by Directive 2000/26/EC of the European Parliament and of the Council of 16 May 2000 on the approximation of the laws of the Member States relating to insurance against civil liability in respect of the use of motor vehicles (fourth motor insurance Directive) (7).

La deuxième directive 88/357/CEE du Conseil du 22 juin 1988 portant coordination des dispositions législatives, réglementaires et administratives concernant l’assurance directe autre que l’assurance sur la vie, fixant les dispositions destinées à faciliter l’exercice effectif de la libre prestation de services (9), devrait être modifiée pour permettre aux succursales des entreprises d'assurances de devenir les représentants de ces entreprises dans la branche de l'assurance automobile, comme c'est déjà le cas pour d'autres branches d'assurance.
Second Council Directive 88/357/EEC of 22 June 1988 on the coordination of laws, regulations and administrative provisions relating to direct insurance other than life assurance and laying down provisions to facilitate the effective exercise of freedom to provide services (9) should be amended in order to permit branches of insurance undertakings to become representatives with respect to motor insurance activities, as already happens with respect to insurance services other than motor insurance.

Having regard to the 72/166/EEC Directive of the Council of 24 April 1972 (First Directive relating to motor insurance) which provides that national insurers' bureaux of the Member States shall conclude between themselves an agreement under which each national insurers' bureau shall guarantee settlement of claims occurring in its territory and caused by the use of vehicles normally based in the territory of another Member State, whether or not such vehicles are insured, in accordance with the requirements of its national law on compulsory insurance,

La première directive 72/166/CEE sur l'assurance automobile a posé les principes fondamentaux destinés à garantir la liberté de circulation des véhicules, à savoir la suppression des contrôles de l'assurance aux frontières et l'assurance obligatoire en responsabilité civile de tous les véhicules de l'UE.
The First Council Directive 72/166/CEE on motor vehicle insurance established the basic principles for ensuring the free movement of motor vehicles, viz. the abolition of frontier checks on insurance and compulsory insurance against civil liability for motor vehicles in the EU.
