Since, under the system laid down in the Staff Regulations, the person concerned must submit a complaint against the decision which he is contesting and then appeal against the decision rejecting his complaint, the EU judicature has held that the action is admissible whether it is directed against the initial decision alone, the decision rejecting the complaint or both, provided that the complaint and the appeal were lodged within the periods prescribed by Articles 90 and 91 of the Staff Regulations.

Furthermore, the administration must examine complaints with an open mind and it is sufficient, in order for it to consider that it is dealing with a complaint within the meaning of Article 90(2) of the Staff Regulations, that a plea has already been raised in the administrative procedure sufficiently clearly to enable the appointing authority to know the criticisms made by the person concerned of the contested decision.

It is also clear from case-law that the administration must examine complaints with an open mind and it is sufficient, in order for it to consider that it is dealing with a complaint within the meaning of Article 90(2) of the Staff Regulations, that a plea has already been raised in the administrative procedure sufficiently clearly to enable the appointing authority to know the criticisms made by the person concerned of the contested decision (see judgment of 13 January 1998 in Case T-176/96 Volger v Parliament, paragraph 65).

Pour qu’une personne entrant dans le champ d’application du statut soit recevable, dans le cadre d’un recours introduit au titre des articles 90 et 91 dudit statut, à demander l’annulation d’un acte lui faisant grief, au sens de l’article 90, paragraphe 2, celle-ci doit posséder, au moment de l’introduction du recours, un intérêt, né et actuel, suffisamment caractérisé à voir annuler cet acte, un tel intérêt supposant que la demande soit susceptible, par son résultat, de lui procurer un bénéfice. In order for a person to whom the Staff Regulations apply to be permitted, in an action pursuant to Articles 90 and 91 of the Staff Regulations, to request annulment of an act adversely affecting him, within the meaning of Article 90(2), he must at the time of bringing the action have a vested and present and sufficiently clear interest in obtaining the annulment of that act and such an interest presumes that the claim should be capable, by its result, of securing an advantage for him. As a condition of admissibility, the applicant’s interest in bringing proceedings must be evaluated at the time when the action is brought.

(6) Pour renforcer la protection des droits des personnes sous enquête, et sans préjudice de l'article 90 bis du statut des fonctionnaires des Communautés européennes et des compétences de la Cour de justice des Communautés européennes en vertu du traité, la personne impliquée personnellement doit disposer, au stade final d'une enquête, du droit de recevoir les conclusions et recommandations du rapport final d'enquête et, si elle estime que des garanties de procédure n'ont pas été respectées à son égard, elle doit pouvoir saisir pour avis le conseiller réviseur institué par le présent règlement.
(6) In order to strengthen the protection of the individual rights of persons under investigation, and without prejudice to Article 90a of the Staff Regulations of Officials of the European Communities and the powers of the Court of Justice of the European Communities under the Treaty, a person implicated personally must be entitled, at the final stage of an investigation, to be provided with the conclusions and recommendations of the final investigation report and, if that person considers that procedural guarantees have not been complied with, must be able to file a request for an opinion with the Review Adviser established by this Regulation.
