IN-CONTEXT TRANSLATIONS

1. 1. Aid to compensate farmers for losses of plants or animals or farm buildings caused by adverse climatic events which can be assimilated to natural disasters shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty if it fulfils the conditions set out in paragraphs 2 to 6, 9 and 10 of this Article as far as plants or animals are concerned, and paragraphs 3 to 8 and 10 of this Article as far as farm buildings are concerned.

Individual aid and aid schemes implemented before the date of entry into force of this Regulation and aid granted under those schemes in the absence of a Commission authorisation and in breach of the notification requirement of Article 88(3) of the Treaty shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt if they fulfil the conditions laid down in Article 3 of this Regulation, except the requirements in paragraph 1 and paragraph 2 (b) and (c) of that Article that express reference be made to this Regulation, and that the summary provided for in Article 20(1) has been submitted before granting aid.

1. Aid to encourage the production of quality agricultural products shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty if it is granted towards the eligible costs listed in paragraph 2 and fulfils the conditions set out in paragraphs 3 to 6 of this Article.

In accordance with Article 24a, operational programmes referred to in Article 33a(4)(b) shall include only the elements referred to in points (i), (ii) and (iv) of Article 87(2)(b), point (d) of Article 87(2), paragraph (5) of Article 87 and point (b) of Article 87(5a).

2. La Commission adopte, par voie d'actes d'exécution, une décision portant approbation des éléments de l'accord de partenariat relevant des paragraphes 1 et 2 de l'article 14 dans les cas où un État membre a fait usage des dispositions de l'article 87, paragraphe 5 ter, pour les éléments requérant une décision de la Commission en vertu de l'article 87, paragraphe 5 sexies, au plus tard quatre mois après la date de soumission de l'accord de partenariat par l'État membre, à condition qu'il ait été donné suite de façon adéquate à toutes les observations de la Commission.
2. The Commission shall adopt a decision, by means of implementing acts, approving the elements of the Partnership Agreement falling under paragraph 1 of Article 14 and under paragraph 2 of Article 14 in cases where a Member State has made use of the provisions of Article 87(5b), for the elements requiring a Commission decision under Article 87(5e) no later than four months after the date of submission by the Member State of the Partnership Agreement , provided that any observations made by the Commission have been adequately taken into account.

5. Sous réserve des paragraphes 1 et 2 du présent article et de l'article 89, les établissements de crédit qui ont obtenu l'autorisation, en vertu de l'article 87, paragraphe 9, d'utiliser leurs propres estimations des pertes en cas de défaut et facteurs de conversion, ne reviennent pas à l'usage des valeurs des pertes en cas de défaut et facteurs de conversion visés à l'article 87, paragraphe 8, sauf pour un motif dûment justifié et à condition que les autorités compétentes l'autorisent.
5. Subject to paragraphs 1 and 2 of this Article and Article 89, credit institutions which have obtained permission under Article 87(9) to use own estimates of LGDs and conversion factors, shall not revert to the use of LGD values and conversion factors referred to in Article 87(8) except for demonstrated good cause and subject to the approval of the competent authorities.

Early retirement aid for fishermen and individual flat-rate premiums in compliance with the provisions of Article 12(1) and (2), Article 12(3)(a), (b) and (c), and Article 12(4)(a) to (e) of, and Annex III to Regulation (EC) No 2792/1999 shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the amount of the aid does not exceed, in subsidy equivalent, the total rate of national and Community subsidies fixed by Annex IV to that Regulation for such aid.
