However, because of the excessive risk, which the application of such a provision might produce for small and medium-sized distributors, the Commission decided to suspend this exclusion from the exemption until a review in 2005, which should reveal whether the conditions in article 81, 3 will not be fulfilled unless the provision becomes applicable.Moreover, for suppliers of new motor vehicles other than passenger cars, a condition limiting the duration of restrictions on the place of establishment of a distributor to five years is necessary in order to allow both parties to adapt their agreements to changing market conditions.
