If a consignment of the categories of animals or goods referred to in Article 47(1) is not presented for the official controls referred to therein, or is not presented in accordance with the requirements laid down in Articles 50(1) and (3), 56(1), (3) and (4), or with the rules adopted under Article 48, Article 49(4), Article 51, Article 53(1) and Article 58, the competent authorities shall order that such consignment be retained or recalled, and placed under official detention without delay.

Without prejudice to Article 2, Article 8(3), Article 32, Article 38(2), Article 42(2), Article 55(6), Article 57(3), Article 58(3), Article 61(2) and (3), Article 62(5), Article 63(2) and (3), the second subparagraph of Article 74(1) and Article 86, insofar as this Directive contains harmonised provisions, Member States shall not maintain or introduce provisions other than those laid down in this Directive.

That date shall be the date of the application of the corresponding rules to be adopted pursuant to the delegated acts provided for in Articles 44(1), 47(1) 48(3), 53(1) 54(3) and 58(2), Article 63, Article 64(4), Article 67, and Articles 68(2) and 70(3) of this Regulation.

The competent authority shall continue to apply the preliminary disease control measures provided for in Article 55(1) and Article 56, until the presence of the listed diseases referred to in Article 8(1)(a) has been ruled out based on the information referred to in Article 58(1) or rules adopted pursuant to Article 58(2).

The actions referred to in this Title may be implemented directly by the Commission pursuant to point (a) of Article 58(1), under shared management pursuant to point (b) of Article 58(1) or indirectly by any entity or person entrusted pursuant to point (c) of Article 58(1), in accordance with the relevant provisions of Articles 58 to 63.

Par "fraudes avérées en grande quantité" au sens de l'article 58, paragraphe 6, on entend une situation dans laquelle il est établi que, malgré l'application éventuelle des articles 54 et 61 et, le cas échéant, de l'article 58 paragraphe 5, la garantie globale visée à l'article 58, paragraphe 1, n'est plus à même d'assurer le paiement dans le délai prévu des dettes nées suite aux soustractions au régime de transit commun de marchandises figurant à l'annexe I, compte tenu de l'ampleur de ces soustractions et des conditions dans lesquelles elles sont effectuées, notamment lorsqu'elles résultent des activités d'une criminalité organisée au plan international.
The "large-scale fraud" referred to in Article 58(6) means a situation where it is established that, in spite of the application of Articles 54 or 61, and where appropriate Article 58(5), the comprehensive guarantee referred to in Article 58(1) is no longer sufficient to ensure payment, within the time limit prescribed, of the debt arising when any of the goods listed in Annex 1 are removed from the common transit procedure. In this connection account should be taken of the volume of goods removed and the circumstances of their removal, particularly if these result from internationally organised criminal activities.
