Sur ce point, les trois services juridiques sont également d'avis que, dans le cadre d'une refonte, le législateur est habilité soit à prévoir une délégation de pouvoirs concernant les points a), b) et c) de l'article 42, soit, pour un ou plusieurs de ces points, à ne déléguer aucun pouvoirs à la Commission (auquel cas la procédure législative ordinaire s'applique à ces modifications), soit encore à conférer des compétences d'exécution à la Commission ou au Conseil en vertu de l'article 291 du traité et du règlement (UE) n° 182/2011.
In that respect, it was also the common understanding of the three legal services that, as part of the recast exercise, the legislator could lay down a delegation of powers in relation to points (a), (b) and (c) of Article 42, or alternatively opt, with regard to one or more of those points, for not delegating its powers to the Commission (therefore rendering the ordinary legislative procedure applicable to the said amendments) or for conferring implementing powers on that institution or on the Council in accordance with Article 291 TFEU and Regulation (EU) No 182/2011.

In the light of all (of) the foregoing considerations, it must be concluded that, by taking the view that the trade mark applied for was devoid of any distinctive character, the Board of Appeal misconstrued the wording of Article 7(1)(b) of Regulation No 40/94 from which it follows that a minimum degree of distinctive character is sufficient to render inapplicable the ground for refusal set out in that article (Case T-34/00 Eurocool Logistik v OHIM (EUROCOOL) [2002] ECR II‑683, paragraph 39.Grille, paragraphs 33 and 49; and Shape of a bottle, paragraph 42).
