By way of derogation from Articles 28(2), 29(1), 29(3) and 30, Member States may continue an authorisation of investment firms and firms covered by Article 30 which was in existence before 31 December 1995, the own funds of which firms or investment firms are less than the initial capital levels specified for them in Articles 28(2), 29(1), 29(3), and 30.

This provision could also restrict the free movement of television signal decoders (in violation of Article 30) and restrict the use of these decoders to access conditional access services originating in other Member States, such as encrypted television channels (and so violate Article 59). * The requirement for prior certification of "equipment" (including decoders) should have been notified under Directive 83/189, and again, may be in breach of Articles 30 and 59 of the Treaty, in that it could restrict the sale or rental of a product (the decoder) which is available legally in other Member States, thereby restricting in addition the provision to viewers in Spain of conditional access and digital television services. * The powers granted by Law 17/1997 to the Regulator to fix tariffs for the use of conditional access systems may be in breach of Article 4(c) of the Television Standards Directive (95/47/EC). * There are doubts concerning the correct implementation of the provisions of Article 4(e) of Directive 95/47/EC for the establishment of dispute settlement procedures.
