The Commission proposes the change of legal basis for these measures, and thus Article 299(2) as a sole legal basis. Until now, the Council has adopted a double legal basis of Article 37 and 299(2) for these types of measures.

In addition to the outermost regions as defined in Article 299 paragraph 2 of the Treaty establishing the European Community and the least favoured regions or islands, including rural areas, as referred to in the second paragraph of Article 158 of the Treaty, there are isolated regions, remote regions which are not easily accessible and sparsely populated regions in the European Union such as those in the northern part of Europe which have characteristics that affect the proper planning and implementation of civil protection.

Le Parlement européen a, à maintes reprises, soutenu la nécessité d'adopter des mesures spécifiques destinées à compenser ces conditions défavorables, comme le prévoit l'article 299, paragraphe 2, du traité CE (voir, notamment, sa résolution du 25 octobre 2000 sur le rapport de la Commission sur les mesures destinées à mettre en œuvre l'article 299 paragraphe 2 : les régions ultrapériphériques de l'Union européenne, JO C 197 du 12.07.01, p.197).
Parliament has repeatedly endorsed the need to adopt specific measures aimed at compensating for these handicaps, as provided for in Article 299(2) of the EC Treaty (see, in particular, its resolution of 25 October 2000 on the Commission report on the measures to implement Article 299(2): the outermost regions of the European Union, OJ C 197, 12.7.2001, p. 197).

Requests that, in the case of state aids, the outermost regions should be able to benefit from the derogation provided for under Article 87(3)(a) of the Treaty, in line with the proposals made in the 'memorandum of the regions'; believes that, on the basis of Article 299(2), the specific fiscal status of each of the outermost regions should be maintained, since the consolidation of the existing benefits accruing from their outermost status is crucial if a more global approach is to be envisaged in the future;

Pour l'avenir, l'article 299 paragraphe 2 permet de mettre en place un régime spécifique pour poursuivre et renforcer cette action : son champ d'application est plus large que celui de l'ancien article 227 paragraphe 2, il permet de prendre des mesures, en recourant à la majorité qualifiée, dans des domaines couvrant plusieurs politiques communautaires.
As for the future, Article 299(2) allows for the introduction of special arrangements to continue and step up this action; its scope is broader than that of the old Article 227(2), and it allows measures to be adopted, by qualified majority, in areas covering more than one Community policy.
