The Commission's proposal is based on Article 141(3) of the Treaty, which empowers the Community to adopt measures to ensure the application of equal treatment of men and women in matters of employment and occupation, and on Treaty Article 141(4), which reiterates that Member States have a duty to adopt measures to ensure that this principle is implemented.
