On new Clause ( 7.1 ) Suzanne Tremblay moved, That Bill C-25 be amended by adding after line 13 on page 4 the following new clause: " 7.1 The Act is amended by adding the following after section 16: APPLICATION OF THE OFFICIAL LANGUAGES ACT 16.1 For greater certainty, the Official Languages Act applies to the Corporation and the Corporation has the duty, under section 25 of that Act, to ensure that, where services are provided or made available by another person or organization on its behalf, any member of the public can communicate with and obtain those services from that person or organization in either official language, in any case where those services, if provided by the Corporation, would be required under Part IV of the Official Languages Act to be provided in either official language" .

Autrement dit, l’article 27 de la charte ne se suffit pas à lui-même pour conférer aux particuliers un droit invocable en tant que tel. La Cour en conclut que la même appréciation s’impose en cas de combinaison de cet article avec les dispositions de la directive 2002/14.
In other words, Article 27 of the Charter does not by itself suffice to confer on individuals a right which they may invoke as such. The Court concludes from this that it is necessary to reach the same assessment where that article is considered in conjunction with the provisions of Directive 2002/14.

(1) The principle of "ne bis in idem", or the prohibition of double jeopardy, according to which no-one should be prosecuted or tried twice for the same acts, facts or behaviour, is established as an individual right in international legal instruments concerning human rights, such as the International Covenant on Civil and Political Rights (Article 14(7)) of 19 December 1966, the Seventh Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms (Article 4) and the Charter of Fundamental Rights of the European Union (Article 50) and is recognised in all legal systems which are based on the concept of respect for and protection of fundamental freedoms.
