Having assessed the reply by the Hungarian authorities, the Commission maintains its legal assessment that the law as amended is not compatible with the fundamental internal market freedoms, notably the freedom to provide services (Article 56 TFEU and Article 16 of Directive 2006/123/EC on services in the internal market) and the freedom of establishment (Article 49 TFEU and Articles 9, 10, 13, 14 of Directive 2006/123/EC), but also not compatible with the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively), as well as not compatible with the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).

4. Dans les cas où la mise en œuvre de la présente directive occasionnerait des problèmes importants dans une zone géographiquement limitée d’un État membre, notamment en ce qui concerne le développement de l’infrastructure de transport et de grande distribution, et en vue d’encourager les investissements, les États membres peuvent demander à la Commission une dérogation temporaire aux articles 4 et 9, à l’article 13, paragraphes 1 et 3, aux articles 14 et 24, à l’article 25, paragraphe 5, aux articles 26, 31 et 32, à l’article 37, paragraphe 1, et/ou à l’article 38 en vue d’améliorer la situation à l’intérieur de cette zone.
4. Where the implementation of this Directive would cause substantial problems in a geographically limited area of a Member State, in particular concerning the development of the transmission and major distribution infrastructure, and with a view to encouraging investments, the Member State may apply to the Commission for a temporary derogation from Articles 4 and 9, Article 13(1) and (3), Articles 14 and 24, Article 25(5), Articles 26, 31 and 32, Article 37(1) and/or Article 38 for developments within that area.
