(2) For the purposes of this subdivision and section 13, where subparagraph 45(1)(a)(i) or paragraph 13(7)(b) would otherwise apply to any property of a taxpayer for a taxation year and the taxpayer so elects in respect of the property in the taxpayer’s return of income for the year under this Part, the taxpayer shall be deemed not to have begun to use the property for the purpose of gaining or producing income except that, if in the taxpayer’s return of income under this Part for a subsequent taxation year the taxpayer rescinds the election in respect of the property, the taxpayer shall be deemed to have begun so to use the property on the first day of that subsequent year.

4. 4. With reference to Article 13, where an individual who ceases to be a resident of a Contracting State, and immediately thereafter becomes a resident of the other Contracting State, is treated for the purposes of taxation in the first-mentioned State as having alienated a property and is taxed in that State by reason thereof, the individual may elect to be treated for purposes of taxation in the other State as if the individual had, immediately before becoming a resident of that State, sold and repurchased the property for an amount equal to its fair market value at that time.

5. En dernier lieu, si la commission des pétitions se réjouit de cette directive et notamment des mesures d'égalité de traitement (prévues à l'article 12) ainsi que des mesures de protection contre l'éloignement (prévues à l'article 13) elle souhaite par contre voir supprimée la perte des bourses d'études pour étudiants (prévue au par.1 de l'article 24) lorsque le migrant acquiert le titre de séjour dans un deuxième Etat membre alors qu'il garde les autres bénéfices prévus à l'article 12.

Finally, although the Committee on Petitions welcomes this directive and in particular the measures on equal treatment (Article 12) and measures to protect against expulsion (Article 13), it thinks that the loss of study grants for students (provided for in Article 24(1)) when the immigrant acquires a residence permit in a second Member State, even though he keeps all the other benefits mentioned in Article 12, should be deleted.
