IN-CONTEXT TRANSLATIONS

La Commission présente les critères d’appréciation de l’article 101, paragraphe 3, du traité sur le fonctionnement de l’Union européenne (TFUE) (article 81, paragraphe 3, du traité instituant la Communauté européenne [traité CE]), permettant d’exempter les accords, décisions d’associations d’entreprises et pratiques concertées, qui sont interdits par l’article 101, paragraphe 1, du TFUE (article 81, paragraphe 1, du traité CE).
The Commission sets out the criteria for assessment under Article 101(3) of the Treaty on the Functioning of the European Union (TFEU) (ex-Article 81(3) of the Treaty Establishing the European Community (TEC)) with a view to exempting agreements between undertakings, decisions by associations of undertakings and concerted practices, which are prohibited under Article 101(1) TFEU (ex-Article 81(1) TEC).

As an exception to this rule, Article 101(3) TFEU (ex-Article 81(3) TEC) provides that the prohibition contained in Article 101(1) TFEU may be declared inapplicable in case of agreements which contribute to improving the production or distribution of goods or to promoting technical or economic progress, while allowing consumers a fair share of the resulting benefits, and which do not impose restrictions which are not indispensable to the attainment of these objectives and do not afford such undertakings the possibility of eliminating competition in respect of a substantial part of the products concerned.

According to Article 1(2) of Regulation (EC) No 1/2003, agreements which are caught by Article 101(1) TFEU but which satisfy the conditions of Article 101(3) TFEU are not prohibited, no prior decision to that effect being required.

(10) L'article 3, paragraphe 1, du règlement (CE) nº 1/2003 dispose que «lorsque les autorités de concurrence des États membres ou les juridictions nationales appliquent le droit national de la concurrence à des accords, des décisions d'associations d'entreprises ou des pratiques concertées au sens de l'article [101, paragraphe 1,] du traité susceptibles d'affecter le commerce entre États membres au sens de cette disposition, elles appliquent également l'article [101] du traité à ces accords, décisions ou pratiques concertées.
(10) Article 3(1) of Regulation (EC) No 1/2003 provides that ‘where the competition authorities of the Member States or national courts apply national competition law to agreements, decisions by associations of undertakings or concerted practices within the meaning of Article [101(1)] of the Treaty which may affect trade between Member States within the meaning of that provision, they shall also apply Article [101] of the Treaty to such agreements, decisions or concerted practices.
