(ii) que plus d'une personne soit admissible parce qu'elle a droit à l'allocation familiale militaire, en application de l'alinéa 5(1)a) de la Loi, la gratification ou le solde impayé de cette dernière, selon le cas, sera mis en disponibilité pour répartition entre ces personnes, de telle manière que le montant versé à chacune d'elles conserve la même proportion, par rapport à la gratification ou au solde impayé de cette dernière, selon le cas, que le montant mensuel de l'allocation familiale militaire payable à l'égard de chacune de ces personnes, à la date du décès ou de la libération du membre, représente par rapport au montant mensuel total de l'allocation familiale militaire qui aurait été payable à ces personnes si elles avaient demandé une allocation familiale militaire; lorsque la gratification n'est pas demandée par toutes ces personnes, ou à leur égard, les personnes qui formulent une telle demande ne recevront que cette partie de la gratification que chacune d'elles aurait touchée si les autres personnes avaient formulé une pareille demande.
(ii) more than one person qualifies by reason of eligibility for dependants' allowance under paragraph 5(1)(a) of the Act, the gratuity or the unpaid balance thereof, as the case may be, shall be made available for division among such persons so that the amount paid to each is in the same proportion to the gratuity or the unpaid balance thereof, as the case may be, as the monthly amount of dependants' allowance payable in respect of each such person at the date of the member's death or discharge is to the total monthly amount of dependants' allowance that would have been payable to such persons had they applied for dependants' allowance; where application for the gratuity is not submitted by or on behalf of all such persons, the persons who do apply shall be paid that portion only of the gratuity which each would have received had the others applied.

(c) where the total of the number of persons in receipt of dependants' allowance on behalf of the deceased member immediately prior to the member's death or discharge and the number of persons eligible under paragraph 5(1)(b) of the Act is more than one, the gratuity or the unpaid balance thereof, as the case may be, shall be made available for division among such persons so that the amount paid to each is in the same proportion to the gratuity or the unpaid balance thereof, as the case may be, as the monthly amount of dependants' allowance paid or payable to or in respect of each such person at the date of the member's death or discharge is to the total monthly amount of dependants' allowance so paid and payable; where application for the gratuity is not submitted by or on behalf of all such persons, the persons who do apply shall be paid that portion only of the gratuity which each would have received had the others applied;

a) si une seule personne recevait l'allocation familiale militaire à l'égard du membre décédé, immédiatement avant le décès ou la libération de celui-ci, et que personne n'ait droit à cette allocation en application de l'alinéa 5(1)b) de la Loi, cette personne recevra la gratification ou le solde impayé de cette dernière, selon le cas;
(a) where there is only one person who was in receipt of dependants' allowance on behalf of the deceased member immediately prior to the member's death or discharge and there is no person eligible under paragraph 5(1)(b) of the Act, that person shall receive the gratuity or the unpaid balance thereof, as the case may be;

(i) qu'une seule personne soit admissible parce qu'elle a droit à l'allocation familiale militaire, en application de l'alinéa 5(1)a) de la Loi, cette personne recevra la gratification ou le solde impayé de cette dernière, selon le cas,

b) si aucune personne ne recevait l'allocation familiale militaire à l'égard du membre décédé, immédiatement avant le décès ou la libération de celui-ci, et qu'une seule personne soit admissible selon les termes de l'alinéa 5(1)b) de la Loi, cette personne recevra la gratification ou le solde impayé de cette dernière, selon le cas;
(b) where there is no person in receipt of dependants' allowance on behalf of the deceased member immediately prior to the member's death or discharge and there is only one person who qualifies under paragraph 5(1)(b) of the Act, that person shall receive the gratuity or the unpaid balance thereof, as the case may be;
