«(2) Constitue une pratique interdite par l'article 60 paragraphe 1 du traité, le fait pour un vendeur d'aligner son offre sur le barème d'un concurrent dans le marché commun en vertu de l'article 60 paragraphe 2 b) du traité, lorsque le vendeur ne peut justifier que les conditions pour l'alignement étaient réunies et, en ce qui concerne la cotation de prix, qu'il a respecté les prescriptions de l'article 3 alinéas (1) et (2) de la présente décision.
"(2) It shall be a prohibited practice within the meaning of Article 60 (1) of the Treaty for a seller to align his quotation on the price list of a competitor in the common market under Article 60 (2) (b) of the Treaty, where the seller cannot show that the conditions for alignment were fulfilled and that as regards the mode of quotation he has observed the requirements of Article 3 (1) and (2) of this Decision.
