On 23 September 2009, the Commission adopted proposals for Regulations establishing EBA, EIOPA, and ESMA. In this respect the Commission wishes to recall the Statements in relation to Articles 290 and 291 TFEU it made at the adoption of the Regulations establishing the European Supervisory Authorities according to which: "As regards the process for the adoption of regulatory standards, the Commission emphasises the unique character of the financial services sector, following from the Lamfalussy structure and explicitly recognised in Declaration 39 to the TFEU.

5. En ce qui concerne les produits dérivés négociés, une plate-forme de négociation qui se trouve en-deçà du seuil pertinent pendant l’année civile précédant la mise en application du présent règlement, peut, avant la mise en application du présent règlement, informer l’AEMF et son autorité compétente qu’elle ne souhaite pas être liée par cet article pour les produits dérivés cotés compris dans ce seuil pendant une période de trente mois à compter de la mise en application du présent règlement.
5. As regards exchange-traded derivatives, a trading venue which falls below the relevant threshold in the calendar year preceding the entry into application of this Regulation, may, before the entry into application of this Regulation, notify ESMA and its competent authority that it does not wish to be bound by this Article for exchange-traded derivatives included within that threshold, for a period of thirty months from the application of this Regulation.
