Étant donné que l’objectif du présent règlement, à savoir clarifier les règles relatives au transit par la zone internationale des aéroports, ne peut pas être atteint de manière suffisante par les États membres et peut donc être mieux atteint au niveau de l’Union, celle-ci peut adopter des mesures, conformément au principe de subsidiarité consacré par l’article 5 du traité sur l’Union européenne.

Since the objective of the proposed measure, namely the establishment of criteria and mechanisms for determining the Member State responsible for examining an asylum application ð for international protection ï lodged in one of the Member States by a third-country national ð or a stateless person ï, cannot be sufficiently achieved by the Member States and, given the scale and effects, can therefore be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(19) Since the objectives of the action to be taken, i.e. the development of the Community's railways and the introduction of passenger rights in international rail traffic, cannot be sufficiently achieved by the Member States alone in view of the significant international dimensions and the need for international co-ordination in international passenger journeys and can, therefore, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

There is no convention dealing with this aspect and maybe there is no need for international legal rules on this question since national legal systems may leave the judge free to take into account not only the circumstances surrounding the facts, but also the past criminal record of the prosecuted person.
