Complements the package of amendments on migration and the refugee crisis by adopting targeted reinforcements in commitment appropriations first and foremost within the European Neighbourhood Instrument (+ EUR 178,1 million) but also in the Development Cooperation Instrument (+ EUR 26,6 million), Humanitarian aid (+ EUR 26 million), the Instrument for Pre-accession Assistance (+ EUR 11,2 million), the Instrument contributing to Stability and Peace (+ EUR 12,6 million) and the European Instrument for Democracy and Human Rights (+ EUR 1 million); while supporting, where necessary, reprioritisation within those programmes to address the most topical challenges, stresses that this must not lead to reduced efforts related to the initial objectives of the respective legal basis, thus risking the destabilisation of the European neighbourhood or other regions concerned; reiterates the need to adopt a comprehensive and human rights-based approach linking migration with development and working towards the integration of legal migrants, asylum seekers and refugees; emphasises the need to reinforce cooperation and commitment with countries of origin and transit to effectively tackle the current migration crisis, and in particular the needs of displaced persons in third countries in fields of health and education; considers, therefore, such reinforcements indispensable to the financing of additional initiatives, on top of the initial objectives of the respective legal bases;

(80)The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Unionin order to: specifythe definitions of "critical functions" and "core business lines", specify the circumstances when an institution is failing or likely to fail specify the circumstances when the asset separation tool should be applied specify the liabilities excluded from the scope of application of the bail-in tool, specify the circumstances when exclusion from the bail-in tool is necessary to ensure the continuation of critical operations and core business lines, specify the criteria for the determination of the minimum amount of eligible liabilities required from institutions for the purposes of the bail in tool, specify the circumstances when, in application of the bail-in tool, existing shares should be cancelled and liabilities should be converted into shares, specify the circumstances when third country resolution proceedings should not be recognised, further specify the conditions under which it should be considered that the target level of the financing arrangements has significantly deviated from the initial level, adopt criteria aimed at adjusting the contributions to the financing arrangements to the risk profile of institutions, define obligations aimed at ensuring the effective payment of the contributions to the financing arrangements and specify the conditions for the mutual borrowing between national financing arrangements.

The Commission shall implement this Decision at Union level, in particular by adopting the necessary financing decisions in accordance with the Regulations establishing the instruments for financing external action relevant to the actions concerned, namely the Development Cooperation Instrument, the European Instrument for Democracy and Human Rights, as established by Regulation (EU) No 235/2014 of the European Parliament and of the Council , the European Neighbourhood Instrument, the Instrument contributing to Stability and Peace, as established by Regulation (EU) No 230/2014 of the European Parliament and of the Council , the Instrument for Pre-accession Assistance, as established by Regulation (EU) No 231/2014 of the European Parliament and of the Council , and the Partnership Instrument for cooperation with third countries, as established by Regulation (EU) No 234/2014 of the European Parliament and of the Council ('the instruments for financing external action ').

Member States shall adopt the necessary measures to ensure that resources paid back to financial instruments, including capital repayments and gains and other earnings or yields generated during a period of at least 8 years after the end of the eligibility period, which are attributable to the support from the European Structural and Investment Funds to financial instruments pursuant to Article 32, are used in accordance with the aims of the programme or programmes, either within the same financial instrument or, following the exit of these resources from the financial instrument, in other financial instruments in both cases provided that an assessment of market conditions demonstrates a continuing need for such investment or in other forms of support .

Recognises the leverage effect of new financial instruments and their potential to mobilise investment, supports increased financing from credit in general, and calls for the use of revolving financial instruments to be extended to those areas eligible for funding which prove to be appropriate; calls for procedures to be simplified to that end and for a greater degree of legal certainty throughout the entire funding period, as well as for the establishment of an EU register showing which projects are provided with loans and which with subsidies; calls for the instruments to be adaptable, so as to ensure they are viable and feasible for all regions and cities; takes the view that at the end of a funding period, at the latest, responsibility for how the funds are spent should transfer to national level or project level; notes that during the current period not all Member States have adopted a decentralised approach to dealing with financial instruments such as JESSICA; emphasises the need for direct access for cities;

11. estime que toutes les parties, dans les transactions entre entreprises (B2B) ou entre entreprises et consommateurs (B2C), devraient être libres de choisir ou de ne pas choisir l'instrument facultatif comme alternative à la législation nationale ou au droit international (adoption volontaire) et appelle donc la Commission à préciser le lien prévu entre un instrument facultatif et le règlement Rome I ainsi que les conventions internationales, et notamment la Convention des Nations Unies sur les contrats de vente internationale de marchandises (CVIM); estime toutefois qu'il est nécessaire de veiller à ce que l'instrument facultatif offre une protection aux consommateurs et aux petites entreprises, compte tenu de leur position en tant que partenaires commerciaux plus faibles, et d'éviter toute confusion lors du choix de la loi applicable; invite dès lors la Commission à compléter l'instrument facultatif par des informations supplémentaires qui expliquent, dans une langue claire, précise et compréhensible, quels sont les droits des consommateurs et que ces droits ne seront pas compromis, de manière à renforcer leur confiance dans cet instrument facultatif et de leur permettre de décider en connaissance de cause s'ils veulent conclure un contrat sur cette base alternative;
11. Believes that all parties, be it in B2B or B2C transactions, should be free to choose or not to choose the OI as an alternative to national or international law (opt-in) and therefore calls on the Commission to clarify the intended relationship of an OI with the Rome -I-Regulation and international conventions including the United Nations Convention on Contracts for the International Sale of Goods (CISG); considers however that further attention is required for ensuring that the OI offers protection to consumers and small businesses given their position as the weaker commercial partner and that any confusion is avoided when making a choice of law; therefore calls on the Commission to complement the OI with the additional information which will explain in a clear, precise and comprehensible language which are the consumer's rights and that they will not be compromised, in order to increase their confidence in the OI and to put them in a position to make an informed choice as to whether they wish to conclude a contract on this alternative basis;
