TRADUCTIONS EN CONTEXTE

Le règlement (UE) no 525/2013 du Parlement européen et du Conseil , adopté récemment, qui a abrogé et remplacé la décision no 280/2004/CE, ne contient pas la base juridique qui permettrait à la Commission d’adopter les règles de mise en œuvre technique nécessaires pour la deuxième période d’engagement du protocole de Kyoto, conformément aux termes de l’amendement de Doha, aux décisions de la conférence des parties à la CCNUCC agissant comme réunion des parties au protocole de Kyoto et à un accord d’exécution conjointe.
The recently adopted Regulation (EU) No 525/2013 of the European Parliament and of the Council , which repealed and replaced Decision No 280/2004/EC, does not contain the legal basis that would enable the Commission to adopt the necessary technical implementation rules for the second commitment period of the Kyoto Protocol in accordance with the terms of the Doha Amendment, the decisions of the Conference of the Parties to the UNFCCC serving as the meeting of the Parties to the Kyoto Protocol and a joint fulfilment agreement.

Afin d’établir des règles cohérentes pour assurer la mise en œuvre technique de la deuxième période d’engagement du protocole de Kyoto dans l’Union, y compris la transition de la première période d’engagement vers la deuxième, permettre le fonctionnement effectif de l’exécution conjointe des engagements de l’Union, de ses États membres et de l’Islande pour la deuxième période d’engagement et garantir sa mise en adéquation avec le fonctionnement du SEQE-UE et la décision no 406/2009/CE, il convient de déléguer à la Commission le pouvoir d’adopter des actes délégués conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne, à compter de la date de la conclusion de l’amendement de Doha par l’Union jusqu’à la fin de la période supplémentaire prévue pour l’exécution des engagements au titre de la deuxième période d’engagement du protocole de Kyoto.
In order to establish coherent rules to ensure the technical implementation of the second commitment period of the Kyoto Protocol in the Union, including the transition from the first to the second commitment period, to enable the effective operation of the joint fulfilment of the commitments of the Union, its Member States and Iceland for the second commitment period, and to ensure its alignment with the operation of the EU ETS and Decision No 406/2009/EC, the power to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission, from the date of conclusion by the Union of the Doha Amendment to the end of the additional period for fulfilling commitments under the second commitment period of the Kyoto Protocol.

(3) Pour tenir compte des besoins techniques, scientifiques, opérationnels ou liés à la sécurité en modifiant ou en complétant les dispositions relatives à la navigabilité, à la protection de l’environnement, aux pilotes, aux opérations aériennes, aux aérodromes, à la GTA/SNA, aux contrôleurs aériens, aux exploitants de pays tiers, à la supervision et au contrôle d’application, aux mesures dérogatoires, aux amendes et astreintes et aux honoraires et redevances, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne.
(3) In order to take into account technical, scientific, operational or safety needs, by amending or supplementing the provisions on airworthiness, environmental protection, pilots, air operations, aerodromes, ATM/ANS, air traffic controllers, third-country operators, oversight and enforcement, flexibility provisions, fines and periodic penalty payments and fees and charges, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission.

Enfin, une série d'amendements techniques concerne le libellé des dispositions qui confèrent à la Commission le pouvoir d'adopter des actes délégués en application de l'article 290 du TFUE, ou des actes d'exécution en application de l'article 291 du même TFUE.
Finally, a number of technical amendments concern the wording of the provisions enable the Commission to adopt delegated acts under Article 290 TFEU or implementing acts under Article 291 TFEU.

Étant donné l’absence de toute proposition de procédure alternative et considérant que seuls quelques amendements techniques du PE ont été approuvés, et puisque le Conseil demande au PE d’adopter la position commune du Conseil avant fin 2010 sans aucune négociation pour définir conjointement le moment le plus opportun pour transmettre sa position, comme cela aurait dû être le cas conformément à l’article 20 de l’accord sur la bonne coopération interinstitutionnelle en matière de codécision, j’approuve le présent rapport pour que la position du Parlement puisse être adoptée et réaffirmée le plus rapidement possible en ce qui concerne les actes délégués en deuxième lecture.
Bearing in mind that no alternative procedure was proposed and that only a few technical amendments of the EP were accepted, and since the Council is asking the EP to adopt the Council’s common position before the end of 2010 without any negotiation to determine jointly the most suitable time to transmit its position, as is required by Article 20 of the agreement on good interinstitutional cooperation in the area of codecision, I approve the present report so that Parliament’s position may be adopted and reiterated as quickly as possible with regard to delegated acts at second reading.

Cet amendement technique corrige un libellé de la Commission et de JURI qui n'est pas conforme au droit, dès lors qu'il n'est pas possible d'exiger l'unanimité pour l'adoption ou la modification d'un règlement relevant de la codécision (Commission et JURI) ni d'ignorer la compétence du Parlement dans la procédure de codécision.
This technical amendment corrects an unlawful drafting from the Commission and JURI as it is possible neither to require unanimity for the adoption or the amendment of a Regulation taken in codecision (Commission and JURI) nor to ignore the competence of the Parliament in the codecision process (JURI).

Il s'agit d'un amendement technique qui tend à corriger la référence à l'initiative "Tout sauf les armes", en renvoyant non pas à l'ancien régime de SPG 2001-2004 mais au nouveau système 2005-2008 qui a été adopté quelque cinq jours après que la Commission eut finalisé la proposition à l'examen.
This is a technical amendment that corrects the reference to the ‘Everything But Arms’ scheme from the old, 2001-2004, GSP scheme to the new, 2005-2008, scheme, which was adopted some five days after the Commission finalised this proposal.

4. Sans préjudice des mesures d'exécution déjà arrêtées, et à l'exception des dispositions énoncées à l'article 26, dès l'expiration d'une période de deux ans après l'adoption de la présente directive, et au 1er avril 2008 au plus tard, l'application des dispositions de ladite directive nécessitant l'adoption de règles techniques, d'amendements et de décisions conformément au paragraphe 2 est suspendue.
4. Without prejudice to the implementing measures already adopted, and except for the provisions laid down in Article 26, upon expiry of a two-year period following the adoption of this Directive and on 1 April 2008 at the latest, the application of its provisions requiring the adoption of technical rules, amendments and decisions in accordance with paragraph 2 shall be suspended.

Given the major technical and economic developments occurring in television broadcasting and the appearance of new communication services in Europe since the Convention was adopted in 1989, and bearing in mind that the European Community had adopted Directive 97/36/EC of the European Parliament and Council of 30 June 1997 amending Directive 89/552/EEC, the Council of Europe saw an urgent need to amend some of the Convention's provisions in order to develop a coherent approach to transfrontier television between the Convention and the revised Directive.
