Whereas Articles 90 (1) and 257 (1) of the Act of Accession provide for a period during which transitional measures may be adopted to facilitate the passage from the arrangements existing in Spain and Portugal before accession to those resulting from the application of the common organization of the markets under the conditions laid down in the Act of Accession, and in particular to cope with appreciable difficulties in implementing the new arrangements at the date laid down; whereas the date of expiry of that period, set at 31 December 1987 in the Act of Accession, was extended by Regulation (EEC) No 4007/87 (2), to 31 December 1992 for Spain and Portugal;

Whereas the accession of Spain and Portugal has resulted in variable calculations of the production refund taking account in particular of the differences in price levels; whereas, to offset those price differences, accession compensatory amounts were introduced; whereas, pursuant to Article 4 of Regulation (EEC) No 591/79, the production refund is to be corrected for Spain and Portugal by the accession compensatory amount applicable to imports from third countries into each of those Member States;

LE CONSEIL DES COMMUNAUTÉS EUROPÉENNES, vu le traité instituant la Communauté économique européenne, vu l'acte d'adhésion de l'Espagne et du Portugal, et notamment son article 396, vu la proposition de la Commission, considérant que, en raison de l'adhésion des États précités, il y a lieu d'adapter le règlement (CEE) n° 357/79 (1), modifié en dernier lieu par le règlement (CEE) n° 3768/85 (2); considérant que cette adaptation doit définir les dates des premières enquêtes à réaliser par les nouveaux États membres, afin de disposer le plus rapidement possible de données permettant d'apprécier l'état du marché viti-vinicole; considérant qu'il est opportun de prévoir une contribution financière de la Communauté aux dépenses encourues par les nouveaux États membres dans le cadre de la première enquête de base prévue dans le règlement (CEE) n° 357/79; considérant que les résultats des enquêtes intermédiaires prévues dans ledit règlement doivent être disponibles pour les nouveaux États membres de manière à permettre d'apprécier la situation du marché viti-vinicole; considérant que le royaume d'Espagne s'est engagé, au cours des négociations d'adhésion, à réaliser la première enquête de base l'année suivant l'adhésion; que la République portugaise réalisera une enquête viticole en 1987 et la première enquête de base en 1989, A ARRÊTÉ LE PRÉSENT RÈGLEMENT:
THE COUNCIL OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economic Community, Having regard to the Act of Accession of Spain and Portugal and in particular Article 396 thereof, Having regard to the proposal from the Commission, Whereas, on account of the accession of Spain and Portugal, it is necessary to adapt Regulation (EEC) No 357/79 (1), as last amended by Regulation (EEC) No 3768/85 (2); Whereas this adaptation must lay down the dates of the first surveys to be conducted by the new Member States so that data allowing the situation in the wine market to be assessed can be obtained as rapidly as possible; Whereas provision should be made for the Community to make a financial contribution towards the expenditure incurred by the new Member States for the first basic survey required by Regulation (EEC) No 357/79; Whereas the results of interim surveys required by the said Regulation have to be available for the new Member States to allow the situation in the wine market to be assessed; Whereas the Kingdom of Spain undertook, in the course of the accession negotiations, to conduct the first basic survey in the year following accession; whereas the Portuguese Republic will conduct a survey of the area under vines in 1987 and the first basic survey in 1989, HAS ADOPTED THIS REGULATION:
