2. L'interdiction énoncée à l'article 81, paragraphe 1, du traité ne s'applique pas aux accords, décisions et pratiques concertées qui existaient à la date d'adhésion de l'Autriche, de la Finlande et de la Suède, ou à la date d'adhésion de la République tchèque, de l'Estonie, de Chypre, de la Lettonie, de la Lituanie, de la Hongrie, de Malte, de la Pologne, de la Slovénie et de la Slovaquie, et qui, à la suite de l'adhésion, entrent dans le champ d'application de l'article 81, paragraphe 1, du traité si, dans les six mois qui suivent la date d'adhésion, ils sont modifiés de manière à remplir les conditions prévues par l’article 3 du présent règlement.
2. The prohibition in Article 81(1) of the Treaty shall not apply to agreements, decisions and concerted practices which were in existence at the date of accession of Austria, Finland and Sweden or at the date of accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia and which, by reason of accession, fall within the scope of Article 81(1) of the Treaty if, within six months from the date of accession, they are so amended that they comply with the conditions laid down in Article 3 of this Regulation.

As required by Article 95(4), as interpreted in the light of Articles 2 and 168 of the Act of Accession, Austria notified the Commission of the actual wording of the national provisions adopted before the accession to the European Union that it intends to maintain, accompanying the request by an explanation of the reasons which, in its opinion, justify the maintenance of those provisions.

Whereas by virtue of Article 13 of Protocol No 9 on road, rail and combined transport in Austria as annexed to the 1994 Act of Accession, Regulation (EEC) No 3118/93 shall only apply from 1 January 1997 to: (a) hauliers with a Community authorization issued by the competent authorities in Austria for the operation of national road haulage services in other Member States, and (b) hauliers with a Community authorization issued by the competent authorities in another Member State for the operation of national road haulage services in Austria;
