The Act of Accession to the European Union by Spain and Portugal contains the explicit decision to remove all restrictions of access to Community waters in December 2002; legally, for reasons of legislative hierarchy which everybody, from the legal expert to the uninitiated in law, understand, the Regulations of 94 and 95 cannot replace the Act of Accession.

Le fait d'être conscients que, pour ce qui est de la problématique canarienne, c'est nous qui, en Espagne, avons négocié l'adhésion de notre pays aux Communautés européennes et dans les traités successifs qui conduisent à celui d'Amsterdam, et la préoccupation constante de voir cette situation spécifique toujours prise en considération se reflètent, déjà en 1985, dans le Protocole spécial no 2 de l'Acte d'adhésion de l'Espagne et du Portugal, dans le règlement (CEE) no 1911/91 du Conseil, qui approuva ce Protocole, et dans le paragraphe 2 lui-même de l'article 299 du traité CE, qui décrit les régions périphériques de l'Union avec une mention particulière pour les Canaries et prescrit la flexibilité nécessaire pour l'application des normes générales à des cas aussi déterminés et vulnérables que celui qui nous occupe ici.
We were aware of the problems of the Canary Islands when we negotiated the accession of our country to the European Community and the successive Treaties, up until Amsterdam, and the constant concern to always take that special situation into account was reflected in the special Protocol 2 of the Act of Accession of Spain and Portugal, back in 1985, in Council Regulation (EEC) 1911/91, which approved the said Protocol, and in section 2 of article 299 of the EC Treaty, which describes the outermost regions of the Union, with special mention of the Canary Islands and lays down the very flexibility in the application of general rules in certain vulnerable cases which we are discussing today.
