(9) With regard to agreements with third countries on particular matters of civil justice falling within the exclusive competence of the Community, a coherent and transparent procedure should be established to authorise a Member State to amend an existing agreement or to negotiate and conclude a new agreement , in particular where the Community itself has not indicated its intention to exercise its external competences to conclude an agreement by way of an already existing negotiating mandate or a proposed negotiating mandate .

(9) Eu égard aux accords conclus avec des pays tiers sur des questions spécifiques liées à la justice civile relevant de la compétence exclusive de la Communauté, il y a lieu d’instituer une procédure cohérente et transparente afin d’autoriser les États membres à modifier un accord avec des pays tiers existants ou à négocier et conclure un nouvel accord, notamment lorsque la Communauté elle-même n’a pas manifesté son intention d’exercer sa compétence externe en vue de conclure un accord au travers d'un mandat de négociation déjà existant ou d'un mandat de négociation envisagé.
(9) With regard to agreements with third countries on specific civil justice issues falling within the exclusive competence of the Community, a coherent and transparent procedure should be established to authorise a Member State to amend an existing agreement or to negotiate and conclude a new agreement, in particular where the Community itself has not indicated its intention to exercise its external competence to conclude an agreement by way of an already existing mandate of negotiation or an envisaged mandate of negotiation.
