H. considérant que la mise en œuvre par Israël de l'accord d'association UE-Israël dans les territoires occupés a entraîné une application inadéquate du droit de l'Union qui, comme la Cour de justice l'a confirmé dans l'affaire "Brita GmbH/Hauptzollamt Hamburg Hafen", ne permet pas aux autorités douanières des États membres d'accorder un régime préférentiel au titre de l'accord d'association UE-Israël aux produits provenant des territoires occupés par Israël;
H. whereas Israel's application of the EU-Israel Association Agreement to the Occupied Territories has resulted in the improper implementation of EU law, which, as confirmed by the Court of Justice in the Brita GmbH v Hauptzollamt Hamburg-Hafen case, does not permit Member States’ customs authorities to grant preferential treatment under the EU-Israel Association Agreement to products from Israeli-occupied territories;

8. rappelle aux parties les engagements qu'elles ont pris à Annapolis de mener des négociations de bonne foi en vue de conclure d'ici la fin 2008 un traité de paix résolvant toutes les questions en suspens, et demande que des résultats tangibles soient rapidement obtenus sur le terrain, notamment en ce qui concerne le droit d'Israël à vivre en sécurité et l'établissement d'un État palestinien viable; soutient la coopération trilatérale entre l'Union européenne, les Israéliens et les autorités palestiniennes dans les domaines politiques clés, conformément à l'accord d'association CE-Israël et à l'accord d'association intérimaire CE-OLP, qui peut promouvoir la paix et les contacts directs entre les personnes; demande à Israël, dans ce contexte, de respecter pleinement l'accord d'association intérimaire CE-OLP, de lever tous les obstacles à sa mise en œuvre et de faciliter la participation des personnes – en particulier des étudiants et des chercheurs –, des entreprises et autres organisations établies dans les territoires palestiniens occupés, aux programmes communautaires dans le cadre de la coopération entre l'UE et l'Autorité palestinienne, en éliminant les obstacles administratifs et physiques et en assurant la libre circulation des personnes concernées;

Reminds the parties of the commitments they made in Annapolis to hold negotiations in good faith with a view to concluding by the end of 2008 a peace treaty resolving all outstanding issues and calls for swift and tangible results on the ground, including the respect of Israel's right to live in security and the establishment of a viable Palestinian State; encourages the trilateral cooperation between the European Union, the Israeli and the Palestinian authorities in key policy areas, in line with the EC-Israel Association Agreement and the EC-PLO Interim Association Agreement, which can promote peace and people-to-people contacts; calls on Israel, in this context, to fully respect the EC-PLO Interim Association Agreement, to lift all impediments to its implementation and to facilitate the participation of individuals – with special regard to students and researchers –, companies and other organisations based in the Occupied Palestinian Territory in Community programme projects under the cooperation between the EU and the Palestinian Authority by removing administrative and physical obstacles and by ensuring the free movement of the persons concerned;

Est-il exact que, depuis l’entrée en vigueur de l’«accord technique» non contraignant concernant la mise en œuvre du protocole relatif aux règles d’origine de l’accord d’association UE-Israël, Israël continue d’appliquer ledit protocole aux territoires occupés et refuse toujours, lorsqu’il délivre des preuves de l’origine en vertu de cet accord d’association, de faire la distinction entre la production réalisée dans ces territoires et celle réalisée sur le territoire de l’État d’Israël?
Since the EU and Israel put into effect a non-binding 'technical arrangement' for the implementation of the Protocol on Origin of the EU-Israel Association Agreement, is it true that Israel still applies the Protocol on Origin to occupied territories and maintains its refusal to distinguish between production carried out in those territories and production carried out in the territory of the State of Israel when it issues proofs of origin under that Agreement?

Du fait que l’accord technique de coopération douanière entre l’UE et Israël, entré en vigueur le 1 février 2005, ne constitue pas une décision juridiquement contraignante prise en vertu de l’accord d’association UE-Israël et n’a pas été approuvé par le Conseil d’association, Israël est-il juridiquement tenu envers la Communauté européenne de continuer à mettre en œuvre l’accord, ou bien cet État a-t-il légalement la possibilité de suspendre à tout moment l’application de celui-ci?
Since the technical arrangement on EU-Israel customs cooperation put into effect on 1 February 2005 was not adopted as a legally binding decision taken under the EU-Israel Association Agreement nor endorsed by the Association Council, is Israel under any legally binding contractual obligation to the European Community to continue implementing the arrangement, or is Israel legally entitled to abandon the arrangement at any time?
