Rejects the interpretation of the Turkish Government that such measures refer to the free movement of services and thus do not fall within the scope of the Ankara Agreement; recalls in this context that the case law established by the European Court of Justice relating to free circulation of goods within the EU (Società Italiana per l’Oleodotto Transalpino (SIOT) v Ministero delle finanze, Ministero della marina mercantile, Circoscrizione doganale di Trieste and Ente autonomo del porto di Trieste, Judgment of the European Court of Justice of 16 March 1983, Case 266/81, European Court reports 1983 p. 731) applies equally to trade between Turkey and the European Union, including Cyprus;

61. rappelle à la Turquie que la reconnaissance de tous les États membres, y compris de Chypre, est une composante nécessaire du processus d'adhésion; demande à la Turquie de prendre des mesures concrètes en vue de la normalisation des relations bilatérales avec la République de Chypre dès que possible; demande instamment à la Turquie de mettre entièrement en œuvre les dispositions qui découlent de l'accord d'Ankara et de son protocole additionnel ainsi que des priorités établies dans le cadre du partenariat d'adhésion; demande instamment aux autorités turques de conserver une attitude constructive dans la recherche d'un règlement global de la question chypriote dans le cadre des Nations unies acceptable par les chypriotes tant grecs que turcs, et fondé sur les travaux antérieurs des Nations unies, pour arriver à une solution fondée sur les principes fondamentaux de l'UE ainsi que sur l'acquis communautaire et, conformément aux résolutions pertinentes des Nations unies, de retirer rapidement leurs forces suivant un calendrier spécifique; se félicite de la rencontre du 3 juillet 2006 entre MM. Papadopoulos et Talat, laquelle a conduit à l'accord du 8 juillet 2006; encourage des contacts ultérieurs afin de poursuivre le dialogue qui devrait conduire à un règlement global;
61. Reminds Turkey that recognition of all Member States, including the Republic of Cyprus, is a necessary component of the accession process; calls upon Turkey to take concrete steps for the normalisation of bilateral relations with the Republic as soon as possible; urges Turkey to fully implement the provisions stemming from the Ankara Agreement and its Additional Protocol as well as the priorities stemming from the Accession Partnership; calls on the Turkish authorities to maintain a constructive attitude in finding a comprehensive settlement of the Cyprus question within the UN framework, acceptable to both Greek Cypriots and Turkish Cypriots and based on the previous work of the UN, leading to an equitable solution based upon the principles on which the EU is founded, as well as on the acquis, and, pursuant to the relevant UN resolutions, to effect an early withdrawal of their forces in accordance with a specific timetable; welcomes the meeting between Mr Papadopoulos and Mr Talat on 3 July 2006, which led to the agreement of 8 July 2006; encourages further contacts in order to pursue dialogue which should lead to a comprehensive settlement;

rappelant sa résolution du 8 novembre 1993 dans laquelle il a réaffirmé la volonté des parties contractantes de constituer une union douanière selon le calendrier et les modalités fixés dans l'accord d'Ankara et son protocole additionnel;
Recalling its resolution of 8 November 1993 in which it reaffirmed the will of the Parties to enter into the Customs Union according to the calendar and modalities set out in the Ankara Agreement and its Additional Protocol;

* l'organisation du regroupement familial dans le respect de la vie familiale et des obligations parentales en matiere d'education. Ces mesures prennent egalement en compte la situation dans la Communaute des travailleurs grecs, espagnols et portugais. En effet, conformement au Protocole additionnel de l'Accord d'Association, les travailleurs turcs ne peuvent pas beneficier d'un traitement plus favorable que celui qui est reserve aux travailleurs des Etats-membres. Pour ceux-ci, des limitations a l'exercice du droit de libre-circulation seront en vigueur jusqu'en 1987 pour la Grece et 1992 (*) pour les deux nouveaux adherents (*) 31 decembre 1995 pour le Luxembourg. - 3 - RAPPEL : Statut actuel des travailleurs turcs dans la Communaute. Sur la base de l'Accord d'Ankara, le Conseil d'Association a decide en 1976 que les Etats-membres s'efforceraient d'accorder une priorite aux travailleurs turcs lorsque les besoins en main-d'oeuvre ne pourraient etre satisfaits par les travailleurs communautaires (*) Le Conseil d'association en juin 1980, a decide d'apporter des ameliorations a ce regime : le travailleur turc a la possibilite apres trois ans d'emploi regulier dans un Etat membre, de postuler a un emploi dans la meme profession et beneficier du libre acces a toute activite salariale apres 4 ans. D'autre part, une cooperation est prevue en faveur des travailleurs turcs et de leurs familles dans les domaines socio-culturels, de la formation professionnelle et de l'echange des jeunes travailleurs. De plus, ce meme Conseil d'Association de juin 1980 a decide que les travailleurs turcs et les membres de leurs familles dans la Communaute pourraient beneficier de l'egalite de traitement avec les travailleurs communautaires, notamment en ce qui concerne les remunerations, les prestations de maladie, de vieillesse, d'invalidite et de chomage.
Despite the economic and social context, in which there is large- scale unemployment in the Community (16.75 million, i.e. 12.4 % of the Community of Twelve's labour force) and an improvement in Turkey's economic situation, with an average growth of 4.4 % in 1980-1985, resulting in unemployment figures which are no longer very different from the Community's, the Commission proposes the following : - 2 - * the consolidation and imporvement of the status of Turkish workers and their families legally resident in the Community, mainly by eliminating the discrimination which still exists as regards living and working conditions. * the establishment of conditions governing access to the labour market of a Member State for Turkish workers provided there are jobs available and with priority being given to the employment of nationals of the Member States. * measures to ensure that families can be reunited, in order to protect family life and enable parents to meet their obligations as regards education. These measures also take into account the situation of Greek, Spanish and Portuguese workers in the Community. The exercise of their right to freedom of movement will be limited until 1987 in the case of Greek workers and 1992 (*) in the case of workers from the two new Member States. Under the Additional Protocol to the Association Agreement, Turkish workers may not enjoy more favourable treatment thant the workers from the Member States (*) 31 December 1995 for Luxembourg - 3 - AIDE-MEMOIRE Present status of Turkish workers in the Community On the basis of the Ankara Agreement, the Association Council decided in 1976 that, for an initial period of four years, the Member States would give priority to Turkish workers if Community labour was not available. In June 198O, the Association Council decided to imporve on thses arrangements : after three years of legal employment in a Member State, the Turkish worker may apply for a job in the same trade or profession and enjoy free ...
