In that context, the national court essentially asks the Court of Justice whether a patent obtained following an application claiming the invention both of the process of manufacture of a pharmaceutical product and of the pharmaceutical product as such, but, because of that reservation, granted only for the process of manufacture, must none the less, by reason of the TRIPs Agreement and from the date of its entry into force, be regarded as also covering the invention of the pharmaceutical product.

L’article 2, paragraphe 1, de l’accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce (ci-après l’«accord ADPIC»), qui constitue l’annexe 1 C de l’accord instituant l’Organisation mondiale du commerce, a été signé à Marrakech le 15 avril 1994 et approuvé par la décision 94/800/CE du Conseil, du 22 décembre 1994, relative à la conclusion au nom de la Communauté européenne, pour ce qui concerne les matières relevant de ses compétences, des accords des négociations multilatérales du cycle de l’Uruguay (1986-1994) (JO L 336, p. 1), dispose:
5 Article 2(1) of the Agreement on Trade-Related Aspects of Intellectual Property Rights (‘the TRIPs Agreement’), which constitutes Annex 1C to the Agreement establishing the World Trade Organisation, signed in Marrakesh on 15 April 1994 and approved by Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the agreements reached in the Uruguay Round multilateral negotiations (1986-1994) (OJ 1994 L 336, p. 1), provides:

Chile shall amend its internal legislation in respect of any of the terms listed in Appendix I of Annex VI (Agreement on trade in spirits drinks and aromatised drinks), as may be necessary so as no longer to assert that they are terms customary in common language as the common name for certain spirits drinks and aromatised drinks in its territory, as foreseen in Article 24(6) of the WTO TRIPs Agreement.
