TRADUCTIONS EN CONTEXTE

Le ministre de la justice, le CSM et la Haute Cour de cassation et de justice doivent mettre la dernière main à un plan d'action pour que le nouveau délai de mise en œuvre des dispositions restantes du code de procédure civile puisse être respecté; afin d'améliorer davantage la transparence et la prévisibilité du processus législatif, et de renforcer les garde-fous internes dans l'intérêt de l'irréversibilité des résultats, le gouvernement et le Parlement doivent garantir la transparence totale et tenir dûment compte des consultations avec les autorités concernées et les parties prenantes dans le cadre du processus décisionnel et des activités législatives relatives au code pénal et au code de procédure pénale, aux lois sur la corruption, aux lois sur l'intégrité (incompatibilités, conflits d'intérêts, enrichissement injustifié), aux lois de la justice (concernant l'organisation du système judiciaire), ainsi qu'au code civil et au code de procédure civile, en s'inspirant de la transparence du processus décisionnel mis en place par le gouvernement en 2016; le gouvernement doit mettre en place un plan d'action adéquat visant à traiter le problème posé par l'exécution des décisions de justice et l'application de la jurisprudence des cours et tribunaux par l'administration publique, comprenant notamment un mécanisme fournissant des statistiques exactes pour permettre le suivi de ces questions à l'avenir.
The Minister of Justice, the SCM and the High Court of Cassation and Justice should finalise an action plan to ensure that the new deadline for the implementation of the remaining provisions of the Code of Civil Procedures can be respected. In order to improve further the transparency and predictability of the legislative process, and strengthen internal safeguards in the interest of irreversibility, the Government and Parliament should ensure full transparency and take proper account of consultations with the relevant authorities and stakeholders in decision-making and legislative activity on the Criminal Code and Code for Criminal Procedures, on corruption laws, on integrity laws (incompatibilities, conflicts of interest, unjustified wealth), on the laws of justice (pertaining to the organisation of the justice system) and on the Civil Code and Code for Civil Procedures, taking inspiration from the transparency in decision-making put in place by the Government in 2016. The Government should put in place an appropriate Action Plan to address the issue of implementation of court decisions and application of jurisprudence of the courts by public administration, including a mechanism to provide accurate statistics to enable future monitoring.

24. Notes that the Commission received a total of nearly 150 000 responses to its public consultation on investment protection and Investor-to-State Dispute Settlement in the Transatlantic Trade and Investment Partnership Agreement, 97 % of which rejected the inclusion of ISDS in TTIP; stresses that the compatibility of any ISDS with the EU judicial system, and in particular the issue of respect for the CJEU’s jurisdiction and governments’ right to regulate, are widely shared concerns among respondents; notes that, unusually, many submissions came from individual respondents, which highlights the scale of public mobilisation over TTIP, and that some respondents, such as trade unions or big civil society organisations, represent large numbers of individual members vastly in excess of the total number of responses received by the Commission; highlights that investment protection provisions should guarantee states’ ability to regulate, and believes that in this regard the CJEU should maintain exclusive jurisdiction over the definitive interpretation of European Union law.

2. prend acte du fait que, eu égard au renouvellement partiel de la Cour de justice le 7 octobre 2012 et à l'urgence de trouver une solution garantissant le bon fonctionnement du Tribunal de la fonction publique, il convient d'adopter dans les plus brefs délais les modifications proposées du statut concernant la Cour de justice, l'organisation du Tribunal et le Tribunal de la fonction publique, comme souligné dans la lettre du 8 mai 2012 du président de la Cour de justice de l'Union européenne;
2. Notes that, having regard to the partial renewal of the Court of Justice on 7 October 2012 and the urgent need to find a solution guaranteeing a proper functioning of the Civil Service Tribunal, it is necessary for the proposed modifications of the Statute relating to the Court of Justice, to the organisation of the General Court and to the Civil Service Tribunal to be adopted without further delay, as pointed out in the letter of the President of the Court of Justice of the European Union of 8 May 2012;

27. Regrets, with regard to the Council's adoption on 27 December 2001, using the written procedure, of two instruments falling under the first pillar and two further instruments falling under the third pillar concerning combating terrorism and the definition of lists of terrorist organisations, that Parliament was consulted only on the regulation on the freezing of assets; deplores the choice of a legal basis falling under the third pillar for the definition of the list of terrorist organisations, thereby excluding all consultation and scrutiny both by national parliaments and the European Parliament, and likewise evading the competence of the Court of Justice;
